Pursuant to section 20 of the Road User Charges Act 1977, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title

This order is the Road User Charges (Rates) Order (No 2) 2010.

2 Commencement

This order comes into force on 15 October 2010.

Road User Charges (Rates) Order (No 2) 2010: confirmed, on 27 November 2010, by section 14(b) of the Subordinate Legislation (Confirmation and Validation) Act 2010 (2010 No 127).

3 Interpretation

In this order, unless the context otherwise requires, Act means the Road User Charges Act 1977.

4 Rates of charges for distance licences increased

The rates of road user charges specified in Part 1 of Schedule 3 of the Act for distance licences are increased to the corresponding rates specified in Schedule 1 of this order.

5 Rates inclusive of GST

The rates referred to in clause 4 are inclusive of goods and services tax.

6 Altered tables of rates

The tables of rates in Parts 1, 2, and 3 of Schedule 3 of the Act, as specified by the Road User Charges (Rates) Order 2010, and as increased by clause 4 of this order, are set out in Schedule 2 of this order.

7 Revocations

Clause 7 of the Road User Charges (Rates) Order 2010 (SR 2010/243) is revoked.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 15 October 2010, increases certain rates of road user charges payable under the Road User Charges Act 1977 (the Act). The new rates for distance licences are specified in Schedule 1 of this order. The tables of rates in Parts 1, 2, and 3 of Schedule 3 of the Act, which include the increased rates referred to in clause 4 of this order, are set out in Schedule 2 of this order.

Notes

1 General

This is a consolidation of the Road User Charges (Rates) Order (No 2) 2010 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.

2 Legal status

A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.

Section 78 of the Legislation Act 2019 provides that this consolidation, published as an electronic version, is an official version. A printed version of legislation that is produced directly from this official electronic version is also an official version.
