Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 December 2010, amends clause 4 of the Submarine Cables and Pipelines Protection Order 2006, which declares a specified area in relation to the Pohokura gas field development to be a protected area for the purposes of the Submarine Cables and Pipelines Protection Act 1996.

Subclause (2) of clause 4 contains certain exceptions.

The exception for a ship that is engaged in an activity other than commercial fishing and is no more than 9 metres in the length is amended so that the exception applies as long as the activity is carried out without directly or indirectly attaching any of the vessel to the sea bed, whether by anchoring or any other means.

The exception for fishing vessels being used for setting and lifting nets or for setting or lifting long lines no longer applies.
