Gas (Safety and Measurement) Amendment Regulations 2025

These regulations are made under section 54 of the Gas Act 1992—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Energy made after consulting the Environmental Protection Authority in accordance with section 54(6) of that Act.

Regulations
1 Title
These regulations are the Gas (Safety and Measurement) Amendment Regulations 2025.
2 Commencement
These regulations come into force on 13 November 2025.
3 Principal regulations
These regulations amend the Gas (Safety and Measurement) Regulations 2010.
4 Regulation 3 amended (Interpretation)
In regulation 3(4), after “Schedule 1”

Schedule 1AA Transitional, savings, and related provisions

Part 1 Provisions relating to Gas (Safety and Measurement) Amendment Regulations 2025
1 Transitional period for complying with new standards
(1)
This clause applies to any provision in these regulations that—
(a)
requires compliance with an official standard; or
(b)
provides that compliance with an official standard is proof of compliance with a provision of these regulations.
(2)
Until the close of 12 November 2026, a person is treated as complying with the provision if they comply with the applicable official standard (if any) referred to in these regulations as in force immediately before 13 November 2025.
(3)
If there is no applicable official standard referred to in these regulations as in force immediately before 13 November 2025, a person need not comply with a provision referred to in subclause (1)(a) until after the close of 12 November 2026.
2 Transitional period for certification bodies
(1)
Until the close of 12 November 2026, the following bodies may certify gas appliances and specified fittings for the purposes of regulation 54(3) (in addition to the bodies specified in clause 1 of Schedule 2A):
(a)
a body that is working within the certification regime of EU Directive 2009/142/EC:
(b)
for appliances that are not covered by EU Directive 2009/142/EC, a body that is working within the certification regime of EU Directive 90/396/ECC.
(2)
Clause 2 of Schedule 2A applies to a certification body referred to in subclause (1)(a) or (b).
3 Existing and in-process distribution systems, gas installations, fittings, and gas appliances
(1)
This clause applies to distribution systems, gas installations, fittings, and gas appliances that, immediately before 13 November 2025, were—
(a)
installed, for sale, or in use in New Zealand; or
(b)
under construction or being installed in New Zealand; or
(c)
in transit to New Zealand; or
(d)
the subject of an irrevocable purchasing order by a person in New Zealand.
(2)
Despite anything to the contrary in these regulations (but subject to subclause (3)),—
(a)
the distribution systems, gas installations, fittings, and gas appliances may continue to be constructed, installed, sold, used, or maintained provided that they—
(i)
are not unsafe; and
(ii)
complied immediately before 13 November 2025, and continue to comply, with the requirements of these regulations as in force immediately before 13 November 2025; and
(b)
the gas installations that meet the requirements in paragraph (a)(ii) may be tested, certified, or inspected in accordance with the requirements of these regulations as in force immediately before 13 November 2025.
(3)
However, if a fitting or gas appliance is certified for the purpose of regulation 54 after 12 November 2026, it must be certified in accordance with Schedule 2A as amended by the Gas (Safety and Measurement) Amendment Regulations 2025.

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 13 November 2025, amend the Gas (Safety and Measurement) Regulations 2010 (the principal regulations).
The amendments incorporate updated New Zealand and international standards and update the bodies that may certify gas appliances and fittings.
The amendments provide for a 1-year transitional period during which people may choose to continue to use the old standards or switch to the new standards (see clause 1 of new Schedule 1AA). If the amendments apply standards to new items not previously covered, a person has until 13 November 2026 to comply with these standards.
A 1-year transitional period also applies to the existing certification bodies (see clause 2 of new Schedule 1AA)
The transitional provisions clarify that items that are existing or in process before the commencement of the amendments can continue to be covered by the principal regulations as they were before the amendments, provided that the items are not unsafe (see clause 3 of new Schedule 1AA).
