Pursuant to section 27 of the Fair Trading Act 1986, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, and on the recommendation of the Minister of Consumer Affairs given in accordance with section 27(3) of that Act, makes the following regulations.

Regulations
1 Title
These regulations are the Consumer Information Standards (Water Efficiency) Regulations 2010.
2 Commencement
These regulations come into force on 1 April 2011.
3 Interpretation
In these regulations, unless the context otherwise requires,—
AS/NZS 2007.1 means the Australia/New Zealand Standard AS/NZS 2007.1:2005: Performance of household electrical appliances—Dishwashers, Part 1: Methods for measuring performance, energy and water consumption (ISBN 0–7337–7061–4)
AS/NZS 2007.2 means the Australia/New Zealand Standard AS/NZS 2007.2:2005: Performance of household electrical appliances—Dishwashers, Part 2: Energy efficiency labelling requirements (ISBN 0–7337–7058–4)
AS/NZS 2040.1 means the Australia/New Zealand Standard AS/NZS 2040.1:2005: Performance of household electrical appliances—Clothes washing machines, Part 1: Methods for measuring performance, energy and water consumption (ISBN 0–7337–7059–2)
AS/NZS 2040.2 means the Australia/New Zealand Standard AS/NZS 2040.2:2005: Performance of household electrical appliances—Clothes washing machines, Part 2: Energy efficiency labelling requirements (ISBN 0–7337–7060–6)
AS/NZS 3662 means the Australia/New Zealand Standard AS/NZS 3662:2005: Performance of showers for bathing, as reissued incorporating amendments January 2009 (ISBN 0–7337–6642–0)
AS/NZS 3718 means the Australia/New Zealand Standard AS/NZS 3718:2005: Water supply—Tap ware, as reissued December 2008 (ISBN 0–7337–6738–9)
AS/NZS 6400 means the Australia/New Zealand Standard AS/NZS 6400:2005: Water efficient products—Rating and labelling, as reissued incorporating amendments December 2006 (ISBN 0–7337–6717–6)
model means a range of items of the same brand of water-using equipment where each item has the same water efficiency performance characteristics
rated capacity means, in relation to a dishwasher, the number of complete place settings, as defined in clause 1.4.8 of AS/NZS 2007.1, that the manufacturer claims can be cleaned and dried when loaded in accordance with the manufacturer’s instructions and with sections 4.3 and 5.2 of AS/NZS 2007.1
rated load capacity means, in relation to a clothes washing machine, the maximum mass of normally soiled cotton (to the nearest 0.5 kg) that the manufacturer claims can be treated by the clothes washing machine in accordance with the requirements of AS/NZS 2040.1
star rating means, in relation to water-using equipment, the number of stars to which that equipment is entitled, ascertained in accordance with the requirements for that equipment set out in Schedule 1
stated wash programme means the wash programme used to determine water efficiency, being,—
(a)
in relation to a dishwasher, the programme, including all associated specific settings, nominated by the person commissioning the testing, to wash a normally soiled load at rated capacity in accordance with subclause 2.2.1 of AS/NZ 2007.2 with the exception of compliance with the performance criteria specified in that subclause; and
(b)
in relation to a clothes washing machine, the programme, including all associated specific settings, nominated by the person commissioning the testing, to wash a normally soiled cotton load at rated load capacity, in accordance with subclause 2.2.1 of AS/NZ 2040.2 with the exception of compliance with the performance criteria specified in that section
water consumption means, in relation to water-using equipment, the water consumption of that equipment ascertained in accordance with the requirements for that equipment set out in Schedule 1
water-using equipment means the following equipment (within the meaning given to each in AS/NZS 6400):
(a)
clothes washing machines:
(b)
dishwashers:
(c)
lavatory equipment:
(d)
showers:
(e)
tap equipment:
(f)
urinal equipment (except for waterless urinals).
4 Application
(1)
On and from 1 April 2011, these regulations apply to water-using equipment that was or is—
(a)
manufactured in New Zealand on or after 1 April 2011; or
(b)
imported into New Zealand on or after 1 April 2011.
(2)
On and from 1 April 2013, these regulations apply to all water-using equipment.
(3)
However, these regulations do not apply to water-using equipment that has been used by a person in New Zealand.
(4)
In subclause (3), equipment is not used by a person by reason only that the person acquired the equipment for the purpose of resupplying it in trade.
Consumer information standards for water efficiency
5 Consumer information standards for water efficiency
The requirements set out in regulations 6 to 12 and Schedules 1 to 3 are, for the purposes of section 27 of the Fair Trading Act 1986, consumer information standards for the water-using equipment to which these regulations apply.
Labelling of water-using equipment when supplied or physically displayed
6 Labelling of water-using equipment with star rating of 1 or more stars
Water-using equipment that has a star rating of 1 or more stars must, when supplied or physically displayed for supply, have the following displayed in a way that is easily readable and clearly visible and attributable to the equipment:
(a)
for all packaged equipment, a label in the form required for that equipment by Part 1 of Schedule 2 displayed on the packaging:
(b)
for unpackaged clothes washing machines and dishwashers, a label in the form required for that equipment by Part 1 of Schedule 2 displayed in the manner set out for that equipment in Schedule 3:
(c)
for unpackaged lavatory equipment, showers, tap equipment, or urinal equipment, either—
(i)
a label in the form required for that equipment by Part 1 of Schedule 2 displayed—
(A)
in the manner set out for that equipment in Schedule 3; or
(B)
in accordance with section B.2 of Annex B of AS/NZS 6400; or
(ii)
both of the following phrases:
(A)
the phrase “water efficiency”
together with the star rating; and
(B)
the phrase “water consumption”
together with the water consumption:
(d)
for showers and tap equipment, the intended water supply pressure (that is, mains pressure or low/unequal pressure).
7 Labelling of water-using equipment with star rating of zero stars
Water-using equipment that has a star rating of zero stars must, when supplied or physically displayed for supply, have the following displayed in a way that is easily readable and clearly visible and attributable to the equipment:
(a)
for all packaged equipment, a label in the form required for that equipment by Part 2 of Schedule 2 displayed on the packaging:
(b)
for unpackaged clothes washing machines and dishwashers, a label in the form required for that equipment by Part 2 of Schedule 2 displayed in the manner set out for that equipment in Schedule 3:
(c)
for unpackaged lavatory equipment, showers, tap equipment, or urinal equipment, either—
(i)
a label in the form required for that equipment by Part 2 of Schedule 2 displayed—
(A)
in the manner set out for that equipment in Schedule 3; or
(B)
in accordance with section B.2 of Annex B of AS/NZS 6400; or
(ii)
both of the following phrases:
(A)
the phrase “WATER WARNING”
in capital letters; and
(B)
the phrase “NOT WATER EFFICIENT when tested in accordance with AS/NZS 6400”
(with the first 3 words in capital letters).
8 Information on labels must comply with information labelling requirements specified in Schedule 1
A label that is required to be displayed on water-using equipment by regulation 6 or 7 must comply with any applicable information labelling requirements specified in Schedule 1.
9 Additional information requirements for equipment requiring ancillary components to achieve stated star rating or water consumption
Lavatory equipment, showers, tap equipment, or urinal equipment that requires an ancillary component or ancillary components to achieve its stated star rating or water consumption must, when supplied, have the following information identified in a way that is attributable to the equipment:
(a)
the ancillary component or components; and
(b)
any assembly or installation instructions for that component or those components; and
(c)
the advice that the components and equipment described in paragraphs (a) and (b) are required for the lavatory equipment, showers, tap equipment, or urinal equipment to achieve its stated star rating or water consumption.
10 Showers and tap equipment may display reduced-size label
Showers and tap equipment (whether packaged or unpackaged) may display a reduced-size label (see variations of AS/NZS 6400 figures B2 and B10 illustrated in Schedule 2) if the full-size label does not fit on the equipment or its packaging.
11 Labelling requirements satisfied by compliance with AS/NZS 6400
Water-using equipment that is labelled in compliance with AS/NZS 6400 is to be treated as complying with the requirements of regulations 6 to 9.
Information requirements when offering to supply on Internet
12 Information requirements when offering to supply on Internet
(1)
Offers to supply water-using equipment on an Internet site must contain one of the following in a way that is easily readable and clearly visible and attributable to the equipment:
(a)
a reproduction of the label referred to in regulation 6 or 7 that would be required to be displayed when the water-using equipment is supplied or physically displayed for supply; or
(b)
for water-using equipment that has a star rating of zero stars, both of the following phrases:
(i)
the phrase “WATER WARNING”
in capital letters; and
(ii)
the phrase “NOT WATER EFFICIENT when tested in accordance with AS/NZS 6400”
(with the first 3 words in capital letters); or
(c)
for water-using equipment with a star rating of 1 or more stars, all of the following phrases and information:
(i)
the phrase “water efficiency”
together with the star rating; and
(ii)
the phrase “water consumption”
together with the water consumption; and
(iii)
in the case of a dishwasher, the rated capacity before the phrase “place settings”
; and
(iv)
in the case of a clothes washing machine, the rated load capacity before the expression “kg”
; and
(v)
in the case of a shower or tap equipment, the intended water supply pressure (that is, mains pressure or low/unequal pressure).
(2)
Offers to supply dishwashers or clothes washing machines on an Internet site must also display the stated wash programme in a way that is easily readable and clearly visible and attributable to the equipment.
(3)
A label referred to in subclause (1)(a) may be scaled up or down on the Internet site, provided it is still easily readable and clearly visible.

Clothes washing machines
Clothes washing machine labels must comply with subclauses B.3.1 and B.3.4 and clause B.4 of AS/NZS 6400 and be in the format and dimensions indicated in figure B5 or B6 of AS/NZS 6400, except that—
(a)
the following rules apply:
(i)
the number of shaded stars or half stars must be equivalent to the model’s star rating; and
(ii)
the portion of the background arch directly behind the shaded star or stars must be shaded light blue (Pantone 5513) or monochrome if permitted by clause B.4; and
(iii)
the background to the section above the bottom dark blue section must be shaded light blue (Pantone 5513); and
(iv)
the dimensions and font sizes within the light blue section, but not the height of the light blue section itself, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated below:
(b)
figure B5 is varied as illustrated:
(c)
figure B6 is varied as illustrated:
Dishwashers
Dishwasher labels must comply with subclauses B.3.1 and B.3.3 and clause B.4 of AS/NZS 6400, and be in the format and dimensions indicated in figure B3 or B4 of AS/NZS 6400, except that—
(a)
the following rules apply:
(i)
the number of shaded stars or half stars must be equivalent to the model’s star rating; and
(ii)
the portion of the background arch directly behind the shaded star or stars must be shaded light blue (Pantone 5513) or monochrome if permitted by clause B.4; and
(iii)
the background to the section above the bottom dark blue section must be shaded light blue (Pantone 5513); and
(iv)
the dimensions and font sizes within the light blue section, but not the height of the light blue section itself, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated below:
(b)
figure B3 is varied as illustrated:

Lavatory equipment
Lavatory equipment labels must comply with subclauses B.3.1 and B.3.5 and clause B.4 of AS/NZS 6400, and be in the format and dimensions indicated in figure B7 of AS/NZS 6400, except that—
(a)
the following rules apply:
(i)
the number of shaded stars or half stars must be equivalent to the model’s star rating; and
(ii)
the portion of the background arch directly behind the shaded star or stars must be shaded light blue (Pantone 5513) or monochrome if permitted by clause B.4; and
(iii)
the background to the section above the bottom dark blue section must be shaded light blue (Pantone 5513); and
(iv)
the dimensions and font sizes within the light blue section, but not the height of the light blue section itself, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated below:
(b)
figure B7 is varied as illustrated:
Showers
Shower labels must comply with subclauses B.3.1 and B.3.2 and clause B.4 of AS/NZS 6400, and be in the format and dimensions indicated in figure B1 or B2 of AS/NZS 6400, except that—
(a)
the following rules apply:
(i)
the number of shaded stars or half stars must be equivalent to the model’s star rating; and
(ii)
the portion of the background arch directly behind the shaded star or stars must be shaded light blue (Pantone 5513) or monochrome if permitted by clause B.4; and
(iii)
the background to the section above the bottom dark blue section must be shaded light blue (Pantone 5513); and
(iv)
the dimensions and font sizes within the light blue section, but not the height of the light blue section itself, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated below:

the following rules apply:
(i)
the number of shaded stars or half stars must be equivalent to the model’s star rating; and
(ii)
the portion of the background arch directly behind the shaded star or stars must be shaded light blue (Pantone 5513) or monochrome if permitted by clause B.4; and
(iii)
the background to the section above the bottom dark blue section must be shaded light blue (Pantone 5513); and
(iv)
the dimensions and font sizes within the light blue section, but not the height of the light blue section itself, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated below:
(b)
subclause B.3.7 is varied by omitting all references to flow controllers:
(c)

the number of shaded stars or half stars must be equivalent to the model’s star rating; and
(ii)
the portion of the background arch directly behind the shaded star or stars must be shaded light blue (Pantone 5513) or monochrome if permitted by clause B.4; and
(iii)
the background to the section above the bottom dark blue section must be shaded light blue (Pantone 5513); and
(iv)
the dimensions and font sizes within the light blue section, but not the height of the light blue section itself, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated below:
(b)
figure B8 is varied as illustrated:
Part 2 Labels for water-using equipment with star rating of zero stars
Labels for water-using equipment with a star rating of zero stars must comply with subclauses B.3.1 and B.3.8 and clause B.4 of AS/NZS 6400, and be in the format and dimensions indicated in figure B11 or B12 of AS/NZS 6400, except that—
(a)
the following rules apply:
(i)
the background to the section above the bottom dark blue section must be shaded light blue (Pantone 5513); and
(ii)
the dimensions and font sizes within the light blue section, but not the height of the light blue section itself, may be adjusted to the extent reasonably necessary to accommodate the variations illustrated below; and
(iii)
figures B11 and B12 are varied by replacing “Does not comply with AS/NZS 6400”
with “not water efficient”
and by replacing “a joint government and industry program”
with “the more stars the more water efficient”

Schedule 3 Placement of labels for unpackaged equipment

1 Clothes washing machines
The label must be—
(a)
affixed to the clothes washing machine; or
(b)
on both sides of a swing tag affixed to the clothes washing machine.
2 Dishwashers
The label must be—
(a)
affixed to the dishwasher; or
(b)
on both sides of a swing tag affixed to the dishwasher.
3 Lavatory equipment
The label must be—
(a)
affixed to the lavatory equipment; or
(b)
on both sides of a swing tag affixed to the lavatory equipment; or
(c)
placed adjacent to the lavatory equipment on any display for the equipment.
4 Showers
The label must be—
(a)
affixed to the shower; or
(b)
on both sides of a swing tag affixed to the shower; or
(c)
placed adjacent to the shower on any display for the shower.
5 Tap equipment
The label must be—
(a)
affixed to the tap equipment; or
(b)
on both sides of a swing tag affixed to the tap equipment; or
(c)
placed adjacent to the tap equipment on any display for the tap equipment.
6 Urinal equipment
The label must be—
(a)
affixed to the urinal equipment (which may include placement on its flushing mechanism); or
(b)
on both sides of a swing tag affixed to the urinal equipment; or
(c)
placed adjacent to the urinal equipment on any display for the equipment.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 April 2011, prescribe consumer information standards for clothes washing machines, dishwashers, lavatory equipment, showers, tap equipment, and urinal equipment (the equipment).
The regulations apply, on and from 1 April 2011, to unused equipment manufactured in or imported into New Zealand on or after that date.
On and from 1 April 2013, these regulations will apply to all unused equipment.
The regulations require the labelling of equipment when it is supplied or physically displayed. The labelling requirements depend on whether the equipment is packaged or unpackaged, and there is a text alternative for a label for unpackaged lavatory equipment, showers, tap equipment, and urinal equipment. Any ancillary component necessary to achieve the water efficiency of the equipment must be identified, along with assembly or installation instructions, when the equipment is supplied.
The regulations also require that offers to supply equipment on an Internet site must contain certain information about water efficiency.
