Pursuant to section 132AB of the Social Security Act 1964, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title

These regulations are the Social Security (Temporary Additional Support) Amendment Regulations (No 4) 2011.

2 Commencement

These regulations come into force on 19 April 2011.

3 Principal regulations amended

These regulations amend the Social Security (Temporary Additional Support) Regulations 2005.

4 Interpretation

Regulation 4 is amended by inserting the following definition in its appropriate alphabetical order:

Individual Support Payments Programme means the programme by that name that has been established and approved by the Minister, under section 124(1)(d) of the Act, for the purpose of providing short-term special assistance to certain people affected by the aftershock of the Canterbury earthquake that occurred on 22 February 2011

5 Schedule 1 amended

Clause 5 of Schedule 1 is amended by inserting the following paragraph after paragraph (ea):

(eb)

the Individual Support Payments Programme (as defined in regulation 4):

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 19 April 2011, amend the Social Security (Temporary Additional Support) Regulations 2005. The effect of the amendments is to exclude payments made under the recently established Individual Support Payments Programme from the definition of chargeable income, which is relevant in determining a person’s eligibility for temporary additional support. The Individual Support Payments Programme is designed to provide short-term special assistance to certain people affected by the aftershock of the Canterbury earthquake that occurred on 22 February 2011.
