War Pensions (Rates of Pensions, Lump Sum Payments, and Allowances) Order 2010: revoked, on 1 April 2011, by clause 6 of the War Pensions (Rates of Pensions, Lump Sum Payments, and Allowances) Order 2011 (SR 2011/11).

Pursuant to sections 74C and 75C of the War Pensions Act 1954, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title

This order is the War Pensions (Rates of Pensions, Lump Sum Payments, and Allowances) Order 2010.

2 Commencement

(1) This order (except clause 4 and Schedule 2) comes into force on 1 April 2010.

(2) Clause 4 and Schedule 2 come into force immediately after the commencement of the rest of this order.

War Pensions (Rates of Pensions, Lump Sum Payments, and Allowances) Order 2010: validated and confirmed, on 27 November 2010, by section 16 of the Subordinate Legislation (Confirmation and Validation) Act 2010 (2010 No 127).

3 Increasing rates of pensions, lump sum payments, and allowances to reflect changes in CPI

(1) Each provision of the War Pensions Act 1954 listed in column 1 of Schedule 1 of this order is amended by omitting the expression set out opposite to it in column 2 in each place where that expression appears and substituting in each case the expression set out opposite to it in column 3.

(2) The amendments made by subclause (1) to Schedule 12 of the War Pensions Act 1954 apply in respect of persons who die on or after 1 April 2010.

4 Further increases to certain amounts

(1) The amounts set out in clauses 1(a) to (c) and 2(a) and (b) of Schedule 11 of the War Pensions Act 1954 (as substituted by clause 3 and Schedule 1 of this order) are further increased in the manner provided in subclause (2) of this clause.

(2) Each provision of Schedule 11 of the War Pensions Act 1954 listed in column 1 of Schedule 2 of this order is amended by omitting the expression set out opposite to it in column 2 in each place where that expression appears and substituting in each case the expression set out opposite to it in column 3.

5 Revocation

The War Pensions (Rates of Pensions, Lump Sum Payments, and Allowances) Order 2009 (SR 2009/21) is revoked.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 April 2010, amends the War Pensions Act 1954 in 2 ways.

First, clause 3 and Schedule 1 increase the following war pensions, lump sum payments, and allowances in accordance with an increase of 1.96% in the All Groups Consumers Price Index:

the maximum rate of a disablement pension:
the maximum rate of an additional pension for severe disablement:
clothing allowances:
the maximum rate of allowance for the services of attendants for disabled pensioners:
the maximum rate of surviving spouses' or surviving partners' pensions:
the maximum rate of additional parents' allowances payable to a surviving spouse or surviving partner:
the maximum rate of children's pensions in ordinary cases:
the maximum rate of war orphans' pensions:
the maximum rates of veterans' pensions:
the maximum payments on death of a veteran or a veteran's spouse, civil union partner, or de facto partner.

Second, clause 4 and Schedule 2 make some additional increases to figures already increased by clause 3 and Schedule 1 in order to implement the Government's commitments in relation to the level of veterans' pensions.

1 General

2 Status of reprints

4 Changes made under section 17C of the Acts and Regulations Publication Act 1989

Section 17C of the Acts and Regulations Publication Act 1989 authorises the making of editorial changes in a reprint as set out in sections 17D and 17E of that Act so that, to the extent permitted, the format and style of the reprinted enactment is consistent with current legislative drafting practice. Changes that would alter the effect of the legislation are not permitted.

A new format of legislation was introduced on 1 January 2000. Changes to legislative drafting style have also been made since 1997, and are ongoing. To the extent permitted by section 17C of the Acts and Regulations Publication Act 1989, all legislation reprinted after 1 January 2000 is in the new format for legislation and reflects current drafting practice at the time of the reprint.

In outline, the editorial changes made in reprints under the authority of section 17C of the Acts and Regulations Publication Act 1989 are set out below, and they have been applied, where relevant, in the preparation of this reprint:
