This notice is administered by the Ministry of Health.
Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

Notice
1 Title
This notice is the Health Practitioners (Quality Assurance Activity—University of Otago SAMM Audit) Notice 2011.
2 Commencement
This notice comes into force on the day after the date of its notification in the Gazette.
3 Interpretation
In this notice, SAMM Audit means the Severe Acute Maternal Morbidity Audit.
4 Declaration of protected quality assurance activity
The University of Otago SAMM Audit described in the Schedule is a protected quality assurance activity.

1 Interpretation
In this schedule,—
activity means the University of Otago SAMM Audit described in clause 4
DHB means a district health board established by or under section 19 of the New Zealand Public Health and Disability Act 2000
participant means a health practitioner who is—
-
(a) providing maternity services at 1 or more of the following district health boards:
(i) the Waikato DHB:
(ii) the Counties Manukau DHB:
(iii) the Hawkes Bay DHB:
(iv) the Capital and Coast DHB; and
(b) participating in the activity.

2 Objective
The objective of the activity is to ensure that maternity patients are provided with the highest possible standard of care.
3 Information
The activity is based on information derived from the clinical case notes of patients to whom maternity services have been provided by the participants.
4 Activity
-
(1) The activity is undertaken by the Women's Health Research Centre at the University of Otago.
(2) The activity involves—
-
(a) reviewing the clinical case notes of maternity patients who were admitted to an intensive care unit—
(i) at any time while pregnant:
(ii) within 42 days after giving birth; and
(b) collecting further details relating to the care and management of those maternity patients; and
(c) identifying from the information obtained under paragraphs (a) and (b) any process or practice that resulted in an outcome for a maternity patient that may have been, but need not have been, an adverse outcome; and
(d) assessing the quality of the maternity services provided by the participants; and
(e) documenting the findings under paragraphs (c) and (d); and
(f) making those findings available to all health practitioners providing maternity services; and
-
(g) making recommendations on how health practitioners may improve their practices and processes so as to—
(i) improve the safety and quality of the maternity services they provide; and
(ii) reduce the incidence of adverse outcomes; and
(h) facilitating and monitoring any recommendations made under paragraph (g).

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice, which comes into force on the day after the date of its notification in the Gazette, declares the University of Otago SAMM Audit to be a protected quality assurance activity. The effect of this declaration is that—
any information that becomes known solely as a result of the activity is confidential; and
any documents brought into existence solely for the purposes of the activity are confidential; and
the persons who engage in the activity in good faith are immune from civil liability.
The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.
Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
