Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings sections 44 to 49 and 53(2) of the Environmental Protection Authority Act 2011 (the Act) into force on 5 December 2011. At the same time, the Climate Change Response Amendment Act 2011 will be brought into force.

Sections 44 to 49 of the Act—

• cancel the appointment of the Registrar under section 11 of the Climate Change Response Act 2002:

• provide for the consequences of the transfer of functions under the Climate Change Response Act 2002 to the Environmental Protection Authority (the EPA):

• continues delegations made by a chief executive of a department under the Climate Change Response Act 2002 as if the delegation were made by the EPA:

• treats contracts (other than employment contracts) made by a chief executive of a department under the Climate Change Response Act 2002 as if they were made by the EPA:

• provides for the continuation of appointment of enforcement officers.

Section 53(2) of the Act makes consequential amendments to regulations made under the Climate Change Response Act 2002.
