Pursuant to section 167 of the Land Transport Act 1998, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
These regulations are the Land Transport (Offences and Penalties) Amendment Regulations (No 2) 2011.
2 Commencement
-
(1) Regulations 5 and 6 come into force at 5 am on 25 March 2012.
(2) The rest of these regulations come into force on 20 October 2011.
3 Principal regulations amended
These regulations amend the Land Transport (Offences and Penalties) Regulations 1999.
4 Schedule 1 amended on 20 October 2011

(1) This regulation amends the part of Schedule 1 relating to the Land Transport (Road User) Rule 2004.
(2) The second item relating to clause 3.6(2) is amended by inserting
“or rider of cycle, moped, or motorcycle”
after“bus”
.(3) The second item relating to clause 3.6(4) is amended by inserting
“or rider of cycle, moped, or motorcycle”
after“bus”
.(4) The item relating to clause 5.6(1)(a) is amended by omitting the item in the first column and substituting
“5.6(1A)(a)”
.(5) The item relating to clause 5.6(1)(b) is amended by omitting the item in the first column and substituting
“5.6(1A)(b)”
.(6) The item set out in Schedule 1 of these regulations is inserted after the item relating to clause 8.4(2)(b).
5 Schedule 1 amended on 25 March 2012

(1) This regulation amends the part of Schedule 1 relating to the Land Transport (Road User) Rule 2004.
(2) The item relating to clause 3.2(1)(c) is amended by omitting the item in the second column and substituting
“Driver facing green disc signal and turning right fails to give way to traffic approaching from the opposite direction and turning left”
.(3) The item relating to clause 4.2(2A) is amended by omitting the item in the second column and substituting
“Driver of right-turning vehicle fails to give way to an approaching left-turning vehicle”
.(4) The first item set out in Schedule 2 of these regulations is inserted after the item relating to clause 4.2(3).
(5) The item relating to clause 4.4 is amended by—
(a) omitting the item in the first column and substituting
“4.4(1)”
; and
(b) inserting
“, cycle path, or shared path”
after“footpath”
in the item in the second column.
(6) The second item set out in Schedule 2 of these regulations is inserted after the item relating to clause 4.4(1).
6 Schedule 2 amended on 25 March 2012

(1) This regulation amends the part of Part 1 of Schedule 2 relating to the Land Transport (Road User) Rule 2004.
(2) The item relating to clause 4.2(2A) is amended by omitting the item in the third column and substituting
“Driver of right-turning vehicle fails to give way to an approaching left-turning vehicle”
.(3) The first item set out in Schedule 3 of these regulations is inserted after the item relating to clause 4.2(3).
(4) The item relating to clause 4.4 is amended by—
(a) omitting the item in the second column and substituting
“4.4(1)”
; and
(b) inserting
“, cycle path, or shared path”
after“footpath”
in the item in the third column.
(5) The second item set out in Schedule 3 of these regulations is inserted after the item relating to clause 4.4(1).

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations amend the Land Transport (Offences and Penalties) Regulations 1999. The amendments update the descriptions of certain offences and insert new offences and penalties to match amendments made by the Land Transport (Road User) Amendment Rule 2011.
Regulations 5 and 6 come into force at 5 am on 25 March 2012. The rest of the regulations come into force on 20 October 2011.
