These regulations are made under section 75 of the Agricultural Compounds and Veterinary Medicines Act 1997—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Food Safety made in accordance with that section and section 78 of that Act.
Regulations
1 Title
These regulations are the Agricultural Compounds and Veterinary Medicines (Exemptions and Prohibited Substances) Amendment Regulations 2016.
2 Commencement
These regulations come into force on 15 December 2016.
3 Principal regulations
These regulations amend the Agricultural Compounds and Veterinary Medicines (Exemptions and Prohibited Substances) Regulations 2011 (the principal regulations).
4 Schedule 1 amended
In Schedule 1, after the item relating to pentachlorobenzene, insert:
Pentachlorophenol and its salts and esters
Toxaphene
Michael Webster,
Clerk of the Executive Council.
Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 15 December 2016, amend Schedule 1 of the Agricultural Compounds and Veterinary Medicines (Exemptions and Prohibited Substances) Regulations 2011.
Schedule 1 sets out substances that are prohibited from use as agricultural compounds or as ingredients in agricultural compounds.
The amendment adds pentachlorophenol (and its salts and esters) and toxaphene to that schedule.
The amendment is complementary to amendments made by the Hazardous Substances and New Organisms (Schedules 1AA and 2A) Order 2016 and the Imports and Exports (Restrictions) Prohibition Order (No 2) 2004 Amendment Order 2016.
