Pursuant to section 161A(1) of the Climate Change Response Act 2002, His Excellency the Governor-General, acting on the recommendation of the Minister for Climate Change Issues and on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title

These regulations are the Climate Change (Eligible Industrial Activities) Amendment Regulations 2011.

2 Commencement

These regulations come into force on 17 March 2011.

3 Principal regulations amended

These regulations amend the Climate Change (Eligible Industrial Activities) Regulations 2010.

4 Aluminium smelting

Regulation 7 is amended by revoking subclause (4) and substituting the following subclause:
- “(4) Despite anything in these regulations, the allocative baselines for the product specified in subclause (2) that is produced by New Zealand Aluminium Smelters Limited (company number 156735) are as follows:
  
  “(a) 2.645, which is the allocative baseline for any 2010 final allocation:
  
  “(b) 2.733, which is the allocative baseline for any 2011 provisional allocation:
  
  “(c) 2.733, which is the allocative baseline for any 2011 final allocation:
  
  “(d) 2.645, which is the allocative baseline for any 2012 provisional allocation.”

These regulations, which come into force on 17 March 2011, amend the Climate Change (Eligible Industrial Activities) Regulations 2010. The amendment adjusts the allocative baselines for products produced by New Zealand Aluminium Smelters Limited.
