Notice
1 Title
This notice is the Medical Practitioners (Quality Assurance Activity: Orthopaedic Services Limited) Notice 2002.
2 Commencement
This notice comes into force on the day after the date of its notification in the Gazette.
3 Declaration of quality assurance activity
The quality assurance activity called the
“Orthopaedic Services Limited Quality Assurance Activity”
and described in the Schedule is a quality assurance activity to which Part 6 of the Medical Practitioners Act 1995 applies.

1 Interpretation
In this schedule, activity means the Orthopaedic Services Limited Quality Assurance Activity.
2 Sponsor
The activity is carried out under the auspices of Orthopaedic Services Limited.
3 Method
-
(1) The activity is based on information derived from—
-
(a) orthopaedic surgeons who—
(i) practise in either or both of the regions of the Bay of Plenty and Waikato; and
(ii) are shareholders of, or are contracted to, Orthopaedic Services Limited; and
(b) orthopaedic surgeons who from time to time provide health services in the place of the orthopaedic surgeons referred to in paragraph (a).
(2) The activity involves—
-
(a) the holding of 6 surgical audit and peer review meetings each year, for which each surgeon engaged in the activity provides the following information:
(i) the total number of the surgeon's operations performed since the last peer review meeting; and
(ii) the number of complications arising from those operations; and
(iii) patient notes and x-rays in respect of those complications; and
-
(b) the review, at each surgical audit and peer review meeting, of—
(i) patient management; and
(ii) treatment decisions; and
(iii) internal auditing procedures; and
(iv) outcomes of treatment; and
(c) the reporting of the outcome of each peer review meeting to the appropriate persons at the relevant hospitals; and
-
(d) the analysis of the following data on patients:
(i) admission and discharge; and
(ii) morbidity; and
(iii) mortality; and
(iv) outcomes of treatment; and
(e) the examination of patients' records; and
(f) the identification and analysis of adverse outcomes of treatment; and
(g) the monitoring of the performance of each surgeon engaging in the activity; and
-
(h) the making of recommendations on how surgeons engaging in the activity can improve their performance so as to—
(i) improve the quality of the care they provide; and
(ii) reduce the incidence of adverse outcomes; and
(i) the monitoring of the implementation of those recommendations.

4 Objective
As required by Part 6 of the Medical Practitioners Act 1995, the objective of the activity is to improve the quality of care provided by the medical practitioners engaged in the activity.

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice declares that the quality assurance activity called the “Orthopaedic Services Limited Quality Assurance Activity”
is a quality assurance activity to which Part 6 of the Medical Practitioners Act 1995 applies. Those who will participate in the activity are—
orthopaedic surgeons practising in either or both of the Bay of Plenty and Waikato regions, and who are shareholders of, or are contracted to, Orthopaedic Services Limited; and
other orthopaedic surgeons (such as locums) who from time to time provide the same health services.
The effect of this declaration is that, subject to certain exceptions,—
any information that becomes known solely as a result of the activity is confidential; and
any documents brought into existence solely for the purposes of the activity are confidential; and
the persons who engage in the activity in good faith are immune from civil liability.
Under section 69 of the Medical Practitioners Act 1995, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
