Hawke's Bay Land Transfer Regulations 1937: revoked, on 12 May 2011, by clause 3 of the Regulatory Reform (Revocations) Order 2011 (SR 2011/99).

Preamble
Enacting authority: His Excellency the Governor-General in Council.
Act pursuant to which the regulations were made: The Hawke's Bay Earthquake Act 1931.
Date on which the regulations were made: 18th day of August, 1937.
Date of notification in Gazette: 26th day of August, 1937.

These regulations may be cited as the Hawke's Bay Land Transfer Regulations 1937.

In the case of any mortgage under the Land Transfer Act 1915, registered in the office of the District Land Registrar at Napier the rate of interest may be increased or reduced or any liability for interest accrued or to accrue may be varied, modified, or discharged by registration of a memorandum in one of the forms set out in Schedule 5 to the Land Transfer Act 1915, with such modifications as the case may require.

In the case of a mortgage registered in the office of the District Land Registrar at Napier and given to His Majesty the King pursuant to section 48 of the Hawke's Bay Earthquake Act 1931, any variation thereof made under the authority of section 104 of the Land Transfer Act 1915, or clause 2 of these regulations shall be deemed to be sufficiently executed on the part of the mortgagee if executed by the Minister of Finance or by the State Advances Superintendent or by such officer of the Government as the Minister of Finance for the time being may from time to time authorize in that behalf.

No fee shall be payable for the registration in the office of the District Land Registrar at Napier of any such variation of mortgage as is referred to in the last preceding clause of these regulations.
