Pursuant to section 123 of the District Courts Act 1947, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations
1 Title
These regulations are the District Courts Fees Amendment Regulations (No 2) 2012.
2 Commencement
These regulations come into force on 4 February 2013.
3 Principal regulations
These regulations amend the District Courts Fees Regulations 2009 (the principal regulations).
4 Regulation 9 amended (Payment of fees for determining setting down dates)

(1) In the heading to regulation 9, replace
“setting down”
with“close of pleadings”
.(2) Replace regulation 9(1) with:

“(1) If the close of pleadings date for a proceeding is determined under High Court Rule 7.6 (as applied by rule 3.51.1 of the District Courts Rules 2009), the fee specified for item 7 of the Schedule is payable by the plaintiff in the proceeding by the earlier of the following days:
“(a) the working day before the commencement of the substantive hearing:
“(b) the 30th working day after the close of pleadings date for the proceeding.”

5 Schedule amended

(1) In the Schedule, item 7, replace
“setting down”
with“the close of pleadings”
.(2) In the Schedule, replace item 9(b) with:
“(b) in the case of a trial that is allocated after a judicial conference, for each half-day or part of each half-day; and
“(c) in every other case, for each half-day or part of a half-day after the first half-day.”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 4 February 2013, amend the District Courts Fees Regulations 2009 (the principal regulations). The amendments—
replace the phrase “setting down” with “close of pleadings” in regulation 9 of the principal regulations to reflect the same change in terminology in the High Court Rules:
update references to the High Court Rules and the District Courts Rules 2009 in regulation 9 of the principal regulations to account for amendments to those rules:
adjust items 7 and 9 of the Schedule of the principal regulations.
