Pursuant to section 4A(1) of the Misuse of Drugs Act 1975 and a resolution of the House of Representatives made on 1 March 2012 in accordance with section 4A(3) of that Act, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
This order is the Misuse of Drugs (Classification of Tapentadol) Order Commencement Order 2012.
2 Commencement of Misuse of Drugs (Classification of Tapentadol) Order 2011
The Misuse of Drugs (Classification of Tapentadol) Order 2011 comes into force on 1 May 2012.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order brings the Misuse of Drugs (Classification of Tapentadol) Order 2011 into force on 1 May 2012. That order adds tapentadol (3-[(1R,2R)-3-(dimethylamino)-1-ethyl-2-methylpropyl]phenol hydrochloride), which is to be classified as a class B3 controlled drug, to Part 3 of Schedule 2 of the Misuse of Drugs Act 1975.
Under section 4A(2) of the Misuse of Drugs Act 1975, this commencement order may be made only after the Misuse of Drugs (Classification of Tapentadol) Order 2011 has been approved by resolution of the House of Representatives. The House of Representatives approved that order on 1 March 2012.
