These regulations are made under sections 30(1) and 146 of the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for the Environment made after complying with the requirements in section 32 of the Act.
Regulations
1 Title
These regulations are the Exclusive Economic Zone and Continental Shelf (Fees and Charges) Amendment Regulations 2023.
2 Commencement
These regulations come into force on 1 July 2023.
3 Principal regulations
These regulations amend the Exclusive Economic Zone and Continental Shelf (Fees and Charges) Regulations 2013.
4 Regulation 4 amended (Recovery of costs by Environmental Protection Authority)
Replace regulation 4(1) with:
(1)
For the purpose of recovering the costs incurred in performing its functions and providing services under the Act, the EPA must charge—
(a)
the hourly charge-out rates for EPA staff set out in the Schedule; and
(b)
actual and reasonable costs for any other expenses that the EPA reasonably incurs.
5 Regulation 5 amended (Exceptions)
In regulation 5(1), replace “in clause 4(1)(a)”
with “set out in the Schedule”
.
6 New Schedule inserted
After regulation 7, insert the Schedule set out in the Schedule of these regulations.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 July 2023, amend the Exclusive Economic Zone and Continental Shelf (Fees and Charges) Regulations 2013 (the principal regulations). The amendments update the hourly charge-out rates for Environmental Protection Authority (EPA) staff by inserting a new Schedule into the principal regulations. The new Schedule contains the hourly charge-out rates effective from 1 July 2023, with 2 additional step increases on 1 July 2024 and 1 July 2025.
