Health Practitioners (Quality Assurance Activity—College of Intensive Care Medicine of Australia and New Zealand) Notice 2013: revoked, on 23 November 2018, pursuant to section 54(4) of the Health Practitioners Competence Assurance Act 2003 (2003 No 48).

Notice

1 Title

This notice is the Health Practitioners (Quality Assurance Activity—College of Intensive Care Medicine of Australia and New Zealand) Notice 2013.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activity

The CICM quality assurance activity described in the Schedule is protected.

4 Revocation of related notice

The Health Practitioners (Quality Assurance Activity—Joint Faculty of Intensive Care Medicine) Notice 2008 (SR 2008/431) is revoked.

5 Revocation of this notice

This notice is revoked at the end of the period for which it remains in force under section 54(4) of the Health Practitioners Competence Assurance Act 2003.

Schedule Description of CICM quality assurance activity

1 Interpretation

In this schedule,—

activity means the activity described in clause 4 of this schedule

CICM means the College of Intensive Care Medicine of Australia and New Zealand

CPD programme means the Continuing Professional Development programme of CICM

participant means a health practitioner who is enrolled in the CPD programme, whether or not a fellow of CICM.

2 Objective

The objective of the activity is to improve the practices and competence of participants by assessing the health services performed by them.

3 Information

The activity is based on information derived from participants.

4 Activity

The activity involves the following quality assurance activities undertaken under the CPD programme:

(a)

participating in—

(i)

clinical audits:

(ii)

patient surveys:

(iii)

critical reviews:

(iv)

morbidity and mortality meetings:

(v)

peer reviews:

(vi)

national or regional quality assurance meetings:

(vii)

hospital quality assurance committee meetings:

(viii)

hospital management meetings primarily about quality assurance:

(b)

being an inspector at hospital accreditation visits:

(c)

facilitating—

(i)

formal audits of the participant’s own practice:

(ii)

peer review of the participant’s own practice:

(iii)

self-assessment tests:

(iv)

practical skills workshops:

(v)

simulator and skills courses:

(vi)

professional practice review.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice comes into force on the day after notification in the Gazette. It declares the CICM quality assurance activity described in the Schedule to be a protected quality assurance activity.

The effect of the declaration is that—

any information that becomes known solely as a result of the activity is confidential; and
any documents brought into existence solely for the purposes of the activity are confidential; and
people who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is revoked before then.

This notice revokes the Health Practitioners (Quality Assurance Activity—Joint Faculty of Intensive Care Medicine) Notice 2008.
