on the recommendation of the Minister of Finance, the Minister of Housing, and the Minister for Social Development; and

(b)

on the advice and with the consent of the Executive Council.

Order

1 Title

This order is the Housing Restructuring and Tenancy Matters (Appointment of Agency and Regulatory Authority) Order 2013.

2 Commencement

This order comes into force on the day after the date of its notification in the Gazette.

3 Ministry of Social Development appointed as social housing agency

The Ministry of Social Development is appointed to perform all of the functions and exercise all of the powers of the agency under the Housing Restructuring and Tenancy Matters Act 1992.

4 Ministry of Business, Innovation, and Employment appointed as regulatory authority

The Ministry of Business, Innovation, and Employment is appointed to perform the functions and exercise the powers of the regulatory authority under Part 10 of the Housing Restructuring and Tenancy Matters Act 1992.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the day after the date of its notification in the Gazette, is made under sections 100 and 159 of the Housing Restructuring and Tenancy Matters Act 1992, as amended by the Social Housing Reform (Housing Restructuring and Tenancy Matters Amendment) Act 2013. This order provides for—

the appointment of the Ministry of Social Development as the social housing agency; and
the appointment of the Ministry of Business, Innovation, and Employment as the regulatory authority.

Sections 100 and 159 came into force on 28 November 2013.
