Fisheries (Declaration of Waitarakao Mātaitai Reserve) Notice 2014
Pursuant to regulation 20 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries, after complying with the requirements set out in regulations 18 and 19 of those regulations, gives the following notice.

1 Title
This notice is the Fisheries (Declaration of Waitarakao Mātaitai Reserve) Notice 2014.
2 Commencement
This notice comes into force on the 28th day after the date of its notification in the Gazette.
3 Declaration of mātaitai reserve
The Minister declares to be a mātaitai reserve (to be known as the Waitarakao Mātaitai Reserve) the area encompassing the following fisheries waters:
(a) Washdyke Lagoon:
(b) all streams, tributaries, and canals that flow into Washdyke Lagoon that are east of the railway line and south of the private road off Meadows Road:
(c) the canal that enters the northern edge of Washdyke Lagoon running northeast to a lagoon located just south of Beach Road.

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice, which comes into force on the 28th day after the date of its notification in the Gazette, is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). This notice declares the area described in clause 3 to be a mātaitai reserve. A mātaitai reserve is an identified traditional fishing ground managed by the tangata whenua through Tangata Tiaki/Kaitiaki. Commercial fishing is generally prohibited in a mātaitai reserve (with exceptions specified in regulation 24 of the regulations). The Tangata Tiaki/Kaitiaki of a mātaitai reserve may authorise any individual to take fisheries resources for customary food gathering purposes from within the whole or any part of the mātaitai reserve.
The Minister’s appointment of the Tangata Tiaki/Kaitiaki for the Waitarakao Mātaitai Reserve is to be notified by the Director-General of the Ministry for Primary Industries in accordance with regulation 22 of the regulations.
