Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

1 Title

This notice is the Health Practitioners (Quality Assurance Activity—Royal Australian and New Zealand College of Psychiatrists’ Peer Review Groups) Notice 2014.

2 Commencement

This notice comes into force on 28 August 2014.

3 Revocation of this notice

This notice is revoked at the end of the period for which it remains in force under section 54(4) of the Health Practitioners Competence Assurance Act 2003.

4 Declaration of protected quality assurance activity

The Royal Australian and New Zealand College of Psychiatrists’ quality assurance activity called The Royal Australian and New Zealand College of Psychiatrists’ Peer Review Groups Activity and described in the Schedule is a protected quality assurance activity.

5 Revocation

The Health Practitioners (Quality Assurance Activity—Royal Australian and New Zealand College of Psychiatrists’ Peer Review Groups) Notice 2009 (SR 2009/226) is revoked.

Schedule Description of The Royal Australian and New Zealand College of Psychiatrists’ Peer Review Groups Activity

1 Interpretation

In this schedule, activity means The Royal Australian and New Zealand College of Psychiatrists’ Peer Review Groups Activity.

2 Objective

The objective of the activity is to improve the practices and competence of health practitioners engaged in the activity by assessing the health services performed by those health practitioners.

3 Information

The activity is based on information derived from health practitioners who participate in the activity and who are—

(a)

fellows of The Royal Australian and New Zealand College of Psychiatrists; or

(b)

registered with, or members of a group registered with, The Royal Australian and New Zealand College of Psychiatrists.

4 Activity

The activity involves—

(a)

reviewing, analysing, and monitoring clinical work through peer review; and

(b)

identifying and analysing adverse outcomes, in the context of peer review; and

(c)

making recommendations on how the health practitioners who engage in the activity can improve their performance so as to—

(i)

improve the quality of care they provide; and

(ii)

reduce the incidence of adverse outcomes; and

(d)

facilitating and monitoring the implementation of any such recommendations.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice comes into force on 28 August 2014. It declares The Royal Australian and New Zealand College of Psychiatrists’ Peer Review Groups Activity described in the Schedule to be a protected quality assurance activity. The effect of this declaration is that—

any information that becomes known solely as a result of the activity is confidential; and
any documents brought into existence solely for the purposes of the activity are confidential; and
the persons who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is revoked before then.

This notice revokes the Health Practitioners (Quality Assurance Activity—Royal Australian and New Zealand College of Psychiatrists’ Peer Review Groups) Notice 2009.
