Parliamentary Salaries Determination 2015: revoked (with effect on 1 July 2015 and after expiring on 30 June 2015), on 10 December 2015, by clause 7(b) of the Parliamentary Salaries and Allowances Determination (No 2) 2015 (LI 2015/316).

Pursuant to section 8 of the Members of Parliament (Remuneration and Services) Act 2013 and to the Remuneration Authority Act 1977 (including, without limitation, clause 4 of Schedule 1AA of that Act), the Remuneration Authority makes the following determination (to which is appended an explanatory memorandum).

Determination

1 Title

This determination is the Parliamentary Salaries Determination 2015.

2 Commencement

This determination is deemed to have come into force on 1 July 2014.

3 Expiry

This determination expires on 30 June 2015.

4 Interpretation

In this determination,—

party means a parliamentary political party whose members in the House of Representatives include at least 1 member elected as a constituency or list candidate for that party

select committee means a committee that is established by, or in accordance with,—

(a)

Standing Order 184(1) or (2) of the Standing Orders of the House of Representatives (with effect on 15 August 2014); or

(b)

the corresponding provision of those Standing Orders (with effect on an earlier or a later date).

5 Salaries

(1)

The salaries payable under section 8 of the Members of Parliament (Remuneration and Services) Act 2013 are set out in the Schedule.

(2)

No member of Parliament may be paid more than 1 salary at any one time under any of the provisions of the Schedule and, if a member holds 2 or more offices, the salary payable to that member is that payable for the office for which the highest salary is payable.

Explanatory memorandum

This memorandum is not part of the determination, but is intended to indicate its general effect.

On 20 March 2015, the Remuneration Authority (Members of Parliament Remuneration) Amendment Act 2015 revoked the provisions relating to the salaries of members of Parliament (MPs) that had been set by the Remuneration Authority in the Parliamentary Salaries and Allowances Determination 2015. The Act reinstates the Authority’s 2013/14 determination in so far as it relates to salaries and requires the Authority to issue a new determination with effect from 1 July 2014.

The Act makes 2 major changes.

It amends the criteria which the Authority must take into account in setting the salaries of MPs. The Authority is now required to adjust salaries by only 1 factor in most cases—the change in the average ordinary time weekly earnings for full-time employees in the public sector, as determined by the Quarterly Employment Survey in the previous 12 months. The change for the relevant period was 1.52%. The salaries of MPs and Ministers set out in this determination are accordingly adjusted on that basis.

It changes the basis on which the Authority is required to calculate the personal benefit of services (such as travel, accommodation and communications) provided to MPs and Ministers when setting salaries. Previously the Authority was required to take into account the value of the personal benefit of services. The Act now requires the Authority to take into account only the value of any personal benefit that arises from a change to entitlements to services compared to entitlements in previous determinations. As a result of this change the Authority no longer has the ability to adjust salaries to reflect fluctuations in the value of the personal benefit of services. The immediate result of this change is that the Authority’s calculations of personal benefit in the 2013/2014 determination are no longer relevant.

There was no change in MPs’ entitlements to services in the period between the 2013/14 salary determination and 1 July 2014, the starting point for this determination. This determination accordingly makes no adjustment to MPs’ salaries for reasons of change in the value of the personal benefit of services resulting from changed entitlements.

The Authority will work with the 2 other agencies involved in providing services to MPs to assess the values under the new criteria over the coming months to ensure that the 2015/16 salary determination, which has a start date of 1 July 2015, will reflect the changes to entitlements in the directions and determinations on services made in September 2014.

The Act did not revoke the tax-free allowances set by the Authority in its 2015 salary determination; they accordingly continue to have effect. These allowances will be reviewed in the 2015/16 determination.

This determination is effective from 1 July 2014 and expires on 30 June 2015.
