Electricity Industry (Enforcement) Amendment Regulations 2015

Pursuant to sections 109 and 112 of the Electricity Industry Act 2010, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Energy and Resources given after consulting the Electricity Authority, makes the following regulations.
Regulations
1 Title
These regulations are the Electricity Industry (Enforcement) Amendment Regulations 2015.
2 Commencement
These regulations come into force on 1 August 2015.
3 Principal regulations
These regulations amend the Electricity Industry (Enforcement) Regulations 2010 (the principal regulations).
4 Regulation 3 amended (Interpretation)
In regulation 3(1), insert in its appropriate alphabetical order:
extended reserve manager means the person appointed by the Authority under the Code to perform the role of extended reserve manager under the extended reserve arrangements created by the Authority under the Code
5 New regulation 70B and cross-heading inserted
After regulation 70A, insert:
Liability of extended reserve manager
70B Limit of liability of extended reserve manager
The extended reserve manager is not liable for a sum in excess of—
(a)
$550,000 in respect of any 1 event or series of closely related events arising from the same cause or circumstance; or
(b)
$550,000 in respect of all events occurring in any financial year.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 August 2015, amend the Electricity Industry (Enforcement) Regulations 2010.
They relate to the appointment by the Electricity Authority of an extended reserve manager under new extended reserve arrangements for managing rare and extreme events that threaten security of supply of electricity. The arrangements were included in the Electricity Industry Participation Code 2010 in 2014.
These regulations—
insert a definition of the extended reserve manager:
set limits on the liability of the extended reserve manager.
A companion regulation, the Electricity Industry (Participants and Roles) Amendment Regulations 2015, provides that the extended reserve manager is a market operation service provider under the Electricity Industry Act 2010.
