This notice is administered by the Ministry of Health.
Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

1 Title
This notice is the Health Practitioners (Quality Assurance Activity—Records Review Study) Notice 2015.
2 Commencement
This notice comes into force on the day after the date of its notification in the Gazette.
3 Revocation of this notice
This notice is revoked at the end of the period for which it remains in force under section 54(4) of the Health Practitioners Competence Assurance Act 2003.
4 Declaration of protected quality assurance activity
The Patient Harms in New Zealand General Practices: Records Review Study described in the Schedule is a protected quality assurance activity.
Schedule Description of Patient Harms in New Zealand General Practices: Records Review Study
1 Interpretation
In this schedule,—
activity means the Patient Harms in New Zealand General Practices: Records Review Study that is conducted by the University of Otago and described in clause 4
participating practice means a general practice that has agreed to participate in the activity.
2 Objective
The objective of the activity is to improve general practice in New Zealand by assessing records kept in relation to health services provided by health practitioners at participating practices in order to identify—
(a)
harm experienced by patients as a direct result of health services provided to them; and
(b)
ways in which to monitor and improve patient safety.
3 Information
The activity is based on information derived from records kept in relation to health services provided by health practitioners at participating practices.
4 Activity
The activity involves persons employed or engaged by the University of Otago—
(a)
reviewing patient records and case notes for health services provided by health practitioners at participating practices between 1 January 2011 and 31 December 2013; and
(b)
identifying, in those records and notes, health services that directly resulted in harm being experienced by patients; and
(c)
in each case, assessing and recording the severity of the harm and the extent to which it was preventable; and
(d)
providing findings under paragraphs (b) and (c) to each participating practice to which the findings relate; and
(e)
asking what (if any) changes those participating practices have made as a result of receiving those findings; and
(f)
providing information based on the findings under paragraphs (b), (c), and (e) to all participating practices; and
(g)
using the findings under paragraphs (b), (c), and (e) to develop a checklist that—
(i)
is designed for New Zealand general practice; and
(ii)
can be used to improve patient safety.

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice, which comes into force on the day after the date of its notification in the Gazette, declares the University of Otago’s Patient Harms in New Zealand General Practices: Records Review Study to be a protected quality assurance activity. The effect of this declaration is that—
any information that becomes known solely as a result of the activity is confidential; and
any documents brought into existence solely for the purposes of the activity are confidential; and
people who engage in the activity in good faith are immune from civil liability.
The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.
Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is revoked before then.
