The Parliamentary Counsel Office has made editorial and format changes to this version using the powers under subpart 2 of Part 3 of the Legislation Act 2019.

These regulations are administered by the Department of Internal Affairs.

Pursuant to section 40 of the Passports Act 1992, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title

These regulations are the Passport (Fees) Regulations 2015.

2 Commencement

These regulations come into force on 30 November 2015.

3 Interpretation

In these regulations, unless the context otherwise requires,—

Act means the Passports Act 1992

adult means a person who is aged 16 years or over

child means a person under the age of 16 years

Internet site means an Internet site maintained by, or on behalf of, the Secretary

New Zealand overseas mission includes a New Zealand overseas post, but excludes a passports office in London or Sydney

passport means a New Zealand passport

passports office means,—

(a)

in New Zealand, an office that is responsible for issuing passports, certificates of identity, and refugee travel documents; and

(b)

in London or Sydney, an office that is responsible for issuing passports.

3A Periods to which fees relate

4 Fees

(1)

The fees payable for applications being lodged online through an Internet site are specified in Part 1 of the Schedule.

(2)

The fees payable for applications being lodged in a passports office in New Zealand are specified in Part 2 of the Schedule.

(3)

The fees payable for applications being lodged in a passports office in London or Sydney are specified in Part 3 of the Schedule.

(4)

The fee payable for applications being lodged in a New Zealand overseas mission for the issue of emergency travel documents is specified in Part 4 of the Schedule.

5 Additional fees

(1)

If an applicant for the issue of a passport or certificate of identity requires the application to be processed within a time frame that would result in the application being given priority over other applications of the same type, the applicant must pay the priority fee specified in item 1 of Part 5 of the Schedule in respect of the application.

(2)

If an applicant for the issue of a passport or certificate of identity requires the application to be processed within a time frame that would require officers to attend outside ordinary working hours, the applicant must pay the callout fee specified in item 2 of Part 5 of the Schedule in respect of the application.

(3)

If an application for the issue of a passport is required to be forwarded by a New Zealand overseas mission to a passports office in New Zealand, London, or Sydney, the applicant must pay the handling fee specified in item 3 of Part 5 of the Schedule in respect of the application.

(4)

The fees referred to in subclauses (1) and (2) are additional to the fee in subclause (3), and to the fees in regulation 4(1), (2), and (3), but are not additional to each other.

(5)

The fee referred to in subclause (3) is additional to the fees referred to in subclauses (1) and (2), and to the fees in regulation 4(2) and (3).

6 Payment of fees

(1)

A priority fee payable in respect of an application may be paid either at the time when the application is made or subsequently.

(2)

All other fees payable in respect of an application must be paid when the application is made.

(3)

Fees paid in respect of an application are not refundable if the application is declined.

7 Waiver of fees in certain cases

(1)

The Secretary may, in the circumstances set out in subclause (2), waive—

(a)

the fee specified in regulation 4(4) for an application for the issue of an emergency travel document:

(b)

the fee specified in regulation 5(1) or (2) for an application for the issue of a passport.

(2)

The circumstances are that—

(a)

the applicant is outside New Zealand when the application is made; and

(b)

the Secretary is satisfied that the timing of the application is dictated by the applicant’s urgent need to travel because of exceptional circumstances that—

(i)

require or may require the applicant to urgently leave the country in which he or she is present; and

(ii)

prevent the applicant from retrieving his or her valid passport (if one exists) because of the urgency of the situation or potential threat to the applicant’s safety (or both).

(3)

For the purposes of subclause (2)(b), exceptional circumstances means—

(a)

an invasion, coup d’état, violent uprising, terrorist act, or war that affects the country in which the applicant is present; or

(b)

a natural disaster or serious outbreak of disease that affects the country in which the applicant is present; or

(c)

the applicant having been the victim of kidnapping or human trafficking while in the country in which he or she is present; or

(d)

any circumstances of a similar nature to those specified in paragraphs (a) to (c).

(4)

The Secretary may waive the fee referred to in regulation 5(1) or (2) for an application for the issue of a passport or certificate of identity if the Secretary is satisfied that the timing of the application is dictated by the applicant’s urgent need to travel because of a situation involving—

(a)

the death or serious illness of—

(i)

a member of the applicant’s family; or

(ii)

a friend or business associate of the applicant; or

(b)

the serious illness of the applicant.

8 Fees exclusive of GST

The fees set out in the Schedule are exclusive of goods and services tax.

9 Revocation

The Passport (Fees) Regulations 1996 (SR 1996/132) are revoked.

1 General

This is a consolidation of the Passport (Fees) Regulations 2015 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.

2 Legal status
