Health and Safety at Work (Major Hazard Facilities) Amendment Regulations (No 2) 2017

These regulations are made under sections 211 and 212 of the Health and Safety at Work Act 2015—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Workplace Relations and Safety made after complying with section 217 of that Act.
Regulations
1 Title
These regulations are the Health and Safety at Work (Major Hazard Facilities) Amendment Regulations (No 2) 2017.
2 Commencement
These regulations come into force on 1 December 2017.
3 Principal regulations
These regulations amend the Health and Safety at Work (Major Hazard Facilities) Regulations 2016 (the principal regulations).
4 Regulation 3 amended (Application)
(1)
In regulation 3(2)(d), replace “regulation 3 of the Hazardous Substances (Classes 1 to 5 Controls) Regulations 2001”
with “regulation 3(1) of the Health and Safety at Work (Hazardous Substances) Regulations 2017”
.
(2)
In regulation 3(2)(e), replace “regulation 11 of the Hazardous Substances (Classes 1 to 5 Controls) Regulations 2001”
with “regulation 3(1) of the Health and Safety at Work (Hazardous Substances) Regulations 2017”
.
5 Regulation 26 amended (Specified hazardous substances)
In regulation 26(2)(a), replace “Hazardous Substances (Classification) Regulations 2001”
with “Hazardous Substances (Classification) Notice 2017”
.
6 Regulation 31 amended (Duty to prepare emergency plan)
In regulation 31(2)(b), replace “Hazardous Substances (Emergency Management) Regulations 2001”
with “Part 5 of the Health and Safety at Work (Hazardous Substances) Regulations 2017”
.
7 Schedule 2 amended
(1)
In Schedule 2, table 1, note 1, replace “regulation 4 of the Hazardous Substances (Classification) Regulations 2001”
with “the Hazardous Substances (Classification) Notice 2017”
.
(2)
In Schedule 2, table 1, note 7, replace “Hazardous Substances (Classification) Regulations 2001”
with “Hazardous Substances (Classification) Notice 2017”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 December 2017, amend the Health and Safety at Work (Major Hazard Facilities) Regulations 2016. The amendments replace references to various regulations made under the Hazardous Substances and New Organisms Act 1996 with references to other instruments that replace those regulations.
