Order

1 Title

This order is the State Sector (Ministry for Vulnerable Children, Oranga Tamariki) Order 2016.

2 Commencement

This order comes into force on 1 April 2017.

3 State Sector Act 1988 amended

In the State Sector Act 1988, Schedule 1, insert in its appropriate alphabetical order:

4 Application of consequential changes to reference provisions

(1)

This clause applies in respect of all functions that are transferred from the Ministry of Social Development to the Ministry for Vulnerable Children, Oranga Tamariki.

(2)

Sections 30H and 30I of the State Sector Act 1988 apply to enactments or other things coming into force, entered into, or created during the transitional period beginning 1 April 2017 and ending on 31 March 2018, after the transfer of functions referred to in subclause (1).

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 April 2017, amends the State Sector Act 1988 (the Act).

Clause 3 inserts a reference to the Ministry for Vulnerable Children, Oranga Tamariki in the list of departments of the Public Service in Schedule 1. The effect of this is that the Act will apply to the Ministry for Vulnerable Children, Oranga Tamariki.

Sections 30H and 30I of the Act concern consequential changes to references to departments, employees, and chief executives following reorganisations. Clause 4 applies those sections to enactments or other things coming into force, entered into, or created during a 12-month transitional period, beginning on 1 April 2017 and ending on 31 March 2018, after functions are transferred from the Ministry of Social Development to the Ministry for Vulnerable Children, Oranga Tamariki.
