Fisheries (Declaration of Ōtākou Mātaitai Reserve) Notice 2016
Pursuant to regulation 20 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries, after complying with the requirements set out in regulations 18 and 19 of those regulations, gives the following notice.

1 Title
This notice is the Fisheries (Declaration of Ōtākou Mātaitai Reserve) Notice 2016.
2 Commencement
This notice comes into force on the 28th day after the date of its notification in the Gazette.
3 Declaration of mātaitai reserve
The Minister declares to be a mātaitai reserve (to be known as Ōtākou Mātaitai Reserve) the area enclosed by a line—
(a)
commencing at a point on the mean high-water springs at the end of the Mole at 45°46.240′S and 170°43.190′E; then
(b)
proceeding in a straight line in a north-easterly direction for approximately 121 metres to a point offshore at 45°46.190′S and 170°43.250′E; then
(c)
proceeding in a straight line in a south-easterly direction to a point on the mean high-water springs at Taiaroa Head at 45°46.360′S and 170°43.700′E; then
(d)
proceeding in a generally southerly direction along the mean high-water springs to a point at Wellers Rock at 45°47.890′S and 170°42.950′E; then
(e)
proceeding in a straight line in a northerly direction for approximately 314 metres to a point offshore at beacon #8 at 45°47.730′S and 170°42.870′E; then
(f)
proceeding in a straight line in a westerly direction for approximately 522 metres to a point offshore at beacon #10 at 45°47.800′S and 170°42.480′E; then
(g)
proceeding in a straight line in a south-westerly direction for approximately 502 metres to a point on the mean high-water springs at the Ōtākou Wharf at 45°48.050′S and 170°42.330′E; then
(h)
proceeding in a generally south-westerly direction along the mean high-water springs to a point at Harwood at 45°48.790′S and 170°40.285′E; then
(i)
proceeding in a straight line in a north-westerly direction to a point on the mean high-water springs at Pulling Point at 45°47.740′S and 170°39.325′E; then
(j)
proceeding in a generally north-easterly direction along the mean high-water springs to a point at Taylor Point at 45°47.340′S and 170°39.990′E; then
(k)
proceeding in a straight line due south for approximately 370 metres to a point offshore at 45°47.540′S and 170°39.990′E; then
(l)
proceeding in a straight line in a north-easterly direction for approximately 901 metres to a point offshore at 45°47.350′S and 170°40.630′E; then
(m)
proceeding in a straight line due north for approximately 408 metres to a point on the mean high-water springs at Otafelo Point at 45°47.130′S and 170°40.630′E; then
(n)
proceeding in a generally north-easterly direction along the mean high-water springs to the point of commencement specified in paragraph (a).

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the 28th day after the date of its notification in the Gazette.
This notice declares the area described in clause 3 to be a mātaitai reserve (to be known as Ōtākou Mātaitai Reserve). The reserve is located in South Island fisheries waters in outer Otago Harbour. The tangata whenua of the area that includes the reserve are represented by Te Rūnanga o Ōtākou.
A mātaitai reserve is an identified traditional fishing ground managed by the tangata whenua through Tangata Tiaki/Kaitiaki. Commercial fishing is generally prohibited in a mātaitai reserve (with exceptions specified in regulation 24 of the regulations).
