This notice is administered by the Ministry for Primary Industries.
Pursuant to section 186A of the Fisheries Act 1996, the Minister for Primary Industries, after complying with the requirements of that section, gives the following notice.
Notice
1 Title
This notice is the Fisheries (Umupuia Beach Temporary Closure) Notice 2016.
2 Commencement
This notice comes into force on 27 October 2016.
3 Revocation of this notice
This notice is revoked on the close of 28 September 2018.
4 Umupuia Beach closed in respect of cockles
(1)
A person must not take cockles from Umupuia Beach while this notice is in force.
(2)
In this clause,—
cockle means a shellfish of the species Chione (Austrovenus) stutchburyi
Umupuia Beach means all those New Zealand fisheries waters enclosed by a line—
(a)
commencing at the mean high-water springs at Te Puea at the western end of the beach known as Umupuia Beach (at 36°53.77′S and 175°03.82′E); then
(b)
proceeding in a straight line in a south-easterly direction to Whakakaiwhara Point (at 36°54.05′S and 175°05.88′E); then
(c)
proceeding along the mean high-water springs to the point of commencement.

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice, which comes into force on 27 October 2016, prohibits the taking of cockles from Umupuia Beach during the period starting on 27 October 2016 and ending on 28 September 2018. Clause 3 revokes this notice on the close of 28 September 2018, in accordance with section 186A(5)(a) of the Fisheries Act 1996 (which provides that the maximum period for which a notice of this type may be in force is 2 years after the date it is notified in the Gazette).
