These regulations are made under section 91(1)(h) and (i) of the Radiation Safety Act 2016—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Health made in accordance with section 91(5) of that Act.
Regulations
1 Title
These regulations are the Radiation Safety Amendment Regulations 2017.
2 Commencement
These regulations come into force on 18 January 2018.
3 Principal regulations
These regulations amend the Radiation Safety Regulations 2016 (the principal regulations).
4 Schedule 3 amended
(1)
In Schedule 3, column 1, item relating to dental therapy practice, paragraph (a), after “dental therapy practice”
, insert “(with no exclusion in taking radiographs)”
.
(2)
In Schedule 3, after the item relating to dental therapy practice, insert:
A health practitioner who— (a)is, or is deemed to be, registered with the Dental Council in the scope of practice of oral health therapy; and (b)holds a current practising certificate |

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 18 January 2018, amend the Radiation Safety Regulations 2016.
Schedule 3 of the Radiation Safety Regulations 2016 authorises specified persons to perform specified activities involving a radiation source without a use licence. These amendments add 2 new groups of authorised persons to that schedule—one in relation to persons registered with the Dental Council in the scope of practice of oral health therapy, and the other in the scope of practice of special needs dentistry. The amendments also make a change to the group of authorised persons that is registered with the Dental Council in the scope of dental therapy practice.
