Fisheries (Declaration of Lyttelton Harbour/Whakaraupō Mātaitai Reserve) Notice 2017
Pursuant to regulation 20 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries gives the following notice after complying with regulations 18 to 20 of those regulations.

1 Title
This notice is the Fisheries (Declaration of Lyttelton Harbour/Whakaraupō Mātaitai Reserve) Notice 2017.
2 Commencement
This notice comes into force on the 28th day after the date of its notification in the Gazette.
3 Declaration of mātaitai reserve
(1)
This notice declares that an area is a mātaitai reserve.
(2)
The mātaitai reserve is to be known as Lyttelton Harbour/Whakaraupō Mātaitai Reserve.
(3)
The area of the mātaitai reserve is the area of South Island fisheries waters within the following lines, but excluding the areas described by subclauses (4) to (6):
(a)
from the starting point at 43°35.950′S and 172°45.450′E (inland of the mean high-water mark near the eastern extremity of Otokitoki/Gollans Bay); then
(b)
by a straight line in a south-easterly direction to 43°37.092′S and 172°46.147′E (inland of the mean high-water mark near the eastern extremity of Deep Gully Bay); then
(c)
by a line in a generally westerly then easterly direction along the mean high-water mark to the starting point.
Te Waipapa/Diamond Harbour wharf excluded
(4)
The first excluded area is the area within the following lines:
(a)
from the starting point at 43°37.371′S and 172°44.201′E (inland of the mean high-water mark to the north of Te Waipapa/Diamond Harbour wharf); then
(b)
by a straight line in a south-westerly direction to 43°37.400′S and 172°44.164′E (offshore); then
(c)
by a straight line in a south-easterly direction to 43°37.422′S and 172°44.195′E (offshore); then
(d)
by a straight line in a north-easterly direction to 43°37.396′S and 172°44.227′E (inland of the mean high-water mark to the east of Te Waipapa/Diamond Harbour wharf); then
(e)
by a line in a generally north-westerly direction along the mean high-water mark to the starting point.
Rāpaki Bay Mātaitai Reserve excluded
(5)
The second excluded area is the area that is defined as the mataitai reserve by clause 2(a) of the Fisheries (Declaration of Mataitai Reserve) Notice 1998 (Gazette 1998, p 4762), as amended by the Fisheries (Declaration of Mataitai Reserve) Notice 1998 Amendment Notice 2015.
Lyttelton Port and Te Awaparahi Bay excluded
(6)
The third excluded area is the area within the following lines:
(a)
from the starting point at 43°36.639′S and 172°42.585′E (inland of the mean high-water mark); then
(b)
by a straight line in an easterly direction to 43°36.622′S and 172°44.007′E (near the end of the Sticking Point breakwater); then
(c)
by a straight line in an easterly direction to 43°36.565′S and 172°44.533′E (offshore); then
(d)
by a straight line in a north-north-westerly direction to 43°36.281′S and 172°44.467′E (offshore); then
(e)
by a straight line in a north-north-westerly direction to 43°36.273′S and 172°44.465′E (offshore); then
(f)
by a straight line in a west-north-westerly direction to 43°36.269′S and 172°44.446′E (offshore); then
(g)
by a straight line in a northerly direction to 43°36.252′S and 172°44.444′E (inland of the mean high-water mark and to the west of Battery Point); then
(h)
by a line in a generally westerly direction along the mean high-water mark to the starting point.

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice is made under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on the 28th day after the date of its notification in the Gazette.
The notice declares Lyttelton Harbour/Whakaraupō Mātaitai Reserve, which is in the inner part of Lyttelton Harbour/Whakaraupō. The tangata whenua of the area that includes the mātaitai reserve are represented by Te Hapū o Ngāti Wheke (Rāpaki) Rūnanga.
A mātaitai reserve is a traditional fishing ground for which Tāngata Tiaki/Kaitiaki are appointed under the regulations.
