These regulations are made under section 402(1)(y) and (z) of the Building Act 2004 on the advice and with the consent of the Executive Council and on the recommendation of the Minister for Building and Construction.
Regulations
1 Title
These regulations are the Building (Infringement Offences, Fees, and Forms) Amendment Regulations 2017.
2 Commencement
These regulations come into force on 1 July 2017.
3 Principal regulations
These regulations amend the Building (Infringement Offences, Fees, and Forms) Regulations 2007 (the principal regulations).
4 Schedule 1 amended
(1)
In Schedule 1, item relating to section 124 of the Building Act 2004, delete “, earthquake-prone,”
.
(2)
In Schedule 1, after the item relating to section 368 of the Building Act 2004, insert:

| s 133AU(1) | Failing to complete seismic work by deadline | 1,000 | ||
| s 133AU(2) | Failing to comply with requirement to attach EPB notice or EPB exemption notice | 1,000 | ||
| s 133AU(3) | Failing, when EPB notice or EPB exemption notice ceases to be attached or becomes illegible, to notify the territorial authority | 1,000 | ||
| s 133AU(5) | Using or occupying an earthquake-prone building, or permitting another person to do so, contrary to a territorial authority’s hoarding, fence, or notice | 2,000 |

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 July 2017, insert 4 new infringement offences into the Building (Infringement Offences, Fees, and Forms) Regulations 2007 and specify the infringement fee for each new infringement offence. The new infringement offences relate to earthquake-prone buildings.
