Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Amendment Notice (No 2) 2018
Pursuant to sections 13, 14, 20, and 75 of the Fisheries Act 1996, the Minister of Fisheries gives the following notice after complying with sections 11, 12, 13, 14, 21, and 75A of that Act.
Notice
1 Title
This notice is the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Amendment Notice (No 2) 2018.
2 Commencement
This notice comes into force on 30 September 2018.
3 Application
This notice applies on and from the first day of the fishing year starting on 1 October 2018.
4 Principal notice
This notice amends the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (the principal notice).
5 Schedule 1 amended
In Schedule 1, replace each item relating to a fishstock code specified in column 1 of Schedule 1 of this notice with the corresponding item in Schedule 1 of this notice.
6 Schedule 2 amended
(1)
In Schedule 2, after the item relating to BNS1, BNS2, and BNS8, insert the items set out in Schedule 2 of this notice.
(2)
In Schedule 2, item relating to BNS3, BNS7, and BNS10, delete “BNS3,”
.
(3)
In Schedule 2, revoke the item relating to BNS3*.
(4)
In Schedule 2, replace the items relating to tarakihi with the items set out in Schedule 3 of this notice.
(5)
In Schedule 2, before the item relating to TRE2, insert the item set out in Schedule 4 of this notice.

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice amends the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015. The amendments commence on 30 September 2018 but apply on and from the first day of the fishing year starting on 1 October 2018.
The amendments set or vary 1 or more of the following things for quota management stocks with certain fishstock codes:
the total allowable catch (TAC):
the total allowable commercial catch (TACC):
the interim deemed value rate (interim DVR):
the basic annual deemed value rate (basic annual DVR):
the different rates that apply to each level by which a commercial fisher’s reported catch exceeds the fisher’s ACE (differential DVR).
The things set or varied by this notice are set out below. Anything not mentioned below is unchanged. Where an original value is cited because it is being varied, that value is taken from the principal notice and ignores various means by which the value may have been varied without amendment to a notice (for example, by allocation of quota for bait under former section 362 of the Fisheries Act 1996). The things set or varied are—
Bluenose
for BNS3 in general, interim DVR increases from $2.70/kg to $3.60/kg, basic annual DVR increases from $3.00/kg to $4.00/kg, and differential DVR changes to the special rates set out in Schedule 2 of this notice:
for BNS3 landed (and received by a licensed fish receiver) in the Chatham Islands, interim DVR increases from $0.95/kg to $1.26/kg, basic annual DVR increases from $1.05/kg to $1.40/kg, and differential DVR changes to the special rates set out in Schedule 2 of this notice:
Elephant fish
for ELE3, TAC increases from 1 060 to 1 285 greenweight tonnes and TACC increases from 1 000 to 1 150 greenweight tonnes:
Flatfish
for FLA1, TAC reduces from 1 762 to 986 greenweight tonnes, TACC reduces from 1 100 to 890 greenweight tonnes, and interim DVR increases from $0.75/kg to $1.35/kg:
Green-lipped mussel
for GLM9, TAC reduces from 278 to 233 greenweight tonnes and TACC reduces from 180 to 135 greenweight tonnes:

for JDO1, TAC is set at 423 greenweight tonnes, TACC reduces from 600 to 354 greenweight tonnes, and interim DVR increases from $1.96/kg to $3.53/kg:

Tarakihi
for TAR1, TAC reduces from 2 029.195 to 1 390 greenweight tonnes, TACC reduces from 1 447.483 to 1 097 greenweight tonnes, interim DVR increases from $1.50/kg to $3.15/kg, basic annual DVR increases from $3.00/kg to $3.50/kg, and the special differential DVR changes to the same rates as for TAR2:
for TAR2, TAC reduces from 2 082 to 1 823 greenweight tonnes, TACC reduces from 1 796 to 1 500 greenweight tonnes, interim DVR increases from $2.48/kg to $3.15/kg, and basic annual DVR increases from $2.75/kg to $3.50/kg:
for TAR3, TAC reduces from 1 503 to 1 174 greenweight tonnes, TACC reduces from 1 403 to 1 040 greenweight tonnes, interim DVR increases from $0.55/kg to $2.25/kg, basic annual DVR increases from $1.09/kg to $2.50/kg, and differential DVR changes from standard to special with the same rates as for TAR7 and TAR8:
for TAR7, TAC is set at 1 174 greenweight tonnes, TACC increases from 930 to 1 042 greenweight tonnes, and interim DVR increases from $1.25/kg to $2.25/kg:
Trevally
for TRE1, interim DVR increases from $0.70/kg to $1.13/kg and differential DVR changes from standard to special at the rates set out in Schedule 4 of this notice.
