These regulations are made under section 297 of the Fisheries Act 1996 on the advice and with the consent of the Executive Council.
Regulations
1 Title
These regulations are the Fisheries (Infringement Offences) Amendment Regulations 2018.
2 Commencement
These regulations come into force on 10 January 2019.
3 Principal regulations
These regulations amend the Fisheries (Infringement Offences) Regulations 2001 (the principal regulations).
4 Regulation 4 amended (Infringement offences)
(1)
In regulation 4(1), after “if”
, delete “the person”
.
(2)
In regulation 4(1)(a), before “commits”
, insert “the person”
.
5 Schedule 1 amended
(1)
In Schedule 1, after the first cross-heading relating to the Fisheries (Reporting) Regulations 2017,—
(a)
item relating to regulation 7(3)(a), second column, replace “after”
with “when”

(b)
item relating to regulation 7(3)(b), second column, replace “after”
with “when”
:
(c)
item relating to regulation 7(3)(c), second column, replace “4 hours”
with “8 hours”
:
(d)
revoke the items relating to regulations 10(3)(a), 10(3)(b) (both items), 11(3)(a), 11(3)(b), 11(3)(c)(i) (both items), and 11(3)(c)(ii) (both items):
(e)
revoke the item relating to regulation 39.

In Schedule 1, after the first cross-heading relating to the Fisheries (Reporting) Regulations 2017, insert in their appropriate numerical order the items set out in the Schedule of these regulations.

In Schedule 1, second cross-heading relating to the Fisheries (Reporting) Regulations 2017, before “Fisheries”

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 10 January 2019, amend the Fisheries (Infringement Offences) Regulations 2001 (the principal regulations). The amendments arise because of changes made to the Fisheries (Reporting) Regulations 2017 by the Fisheries (Reporting) Amendment Regulations 2018. Schedule 1 of the principal regulations is amended to—
include infringement offences and penalties relating to the new obligation to provide a trip start and trip end report in the Fisheries (Reporting) Amendment Regulations 2018; and
reflect changes made to the Fisheries (Reporting) Regulations 2017.
