This order is made under section 13(2) of the Commodity Levies Act 1990 (as applied by section 305 of the Fisheries Act 1996)—

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister for Oceans and Fisheries given after complying with the requirements of section 5 of the Commodity Levies Act 1990 (except section 5(1)(b)).

Order

1 Title

This order is the Commodity Levies (Mussels, Oysters, and Salmon) Amendment Order 2024.

2 Commencement

This order comes into force on 13 June 2024.

Order: confirmed, on 24 December 2024, by section 8(e) of the Secondary Legislation Confirmation Act 2024 (2024 No 58).

3 Principal order

This order amends the Commodity Levies (Mussels, Oysters, and Salmon) Order 2019.

4 New clause 2A inserted (Extension and revocation)

After clause 2, insert:

2A Extension and revocation

This order is extended until the close of 13 June 2030 and, unless further extended or sooner revoked, is revoked on that date.

5 Clause 3 amended (Interpretation)

In clause 3, definition of levy year, paragraph (b), replace “1 September 2024 and ending on 13 June 2025” with “1 September 2029 and ending on 13 June 2030”.

6 Clause 24 amended (Remuneration of persons conducting compliance audits)

In clause 24, replace “Minister of Fisheries” with “Minister for Oceans and Fisheries”.

Explanatory note

This note is not part of the order but is intended to indicate its general effect.

This order, which comes into force on 13 June 2024, amends the Commodity Levies (Mussels, Oysters, and Salmon) Order 2019 (the principal order). This order—

extends by 5 years the period for which the principal order is in force; and
amends the definition of levy year in the principal order to reflect that extension; and
replaces a reference in the principal order to the Minister of Fisheries with a reference to the Minister for Oceans and Fisheries.

This order must be confirmed by an Act before the close of 30 June 2025. If it is not confirmed, it will be revoked on the close of that date. See subpart 3 of Part 5 of the Legislation Act 2019.

1 General

This is a consolidation of the Commodity Levies (Mussels, Oysters, and Salmon) Amendment Order 2024 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
