These regulations are administered by the Ministry for Primary Industries.
These regulations are made under section 134 of the Dairy Industry Restructuring Act 2001—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Agriculture made after meeting the requirements in that section.
Regulations
1 Title
These regulations are the Dairy Industry (Fonterra Levy) Regulations 2019.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Levy
The Fonterra Co-operative Group Limited must pay a levy of $509,847 to the Minister for the financial year beginning on 1 July 2018 and ending on 30 June 2019.
4 Levy exclusive of GST
The amount of the levy in regulation 3 is exclusive of goods and services tax.
5 Revocation
The Dairy Industry (Fonterra Levy) Regulations 2018 (LI 2018/80) are revoked.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force 28 days after the date of their notification in the Gazette, require the Fonterra Co-operative Group Limited to pay a levy of $509,847 for the 2018/19 financial year.
The purpose of the levy is to recover some of the Commerce Commission’s costs, including the costs of making determinations and enforcing subparts 5 and 5A of Part 2 of the Dairy Industry Restructuring Act 2001.
The levy is calculated by adding an under-recovery of those costs of $72,873 (excluding GST) in the 2017/18 financial year to the estimated costs of $436,974 (excluding GST) for the 2018/19 financial year.
These regulations also revoke the Dairy Industry (Fonterra Levy) Regulations 2018, which set the levy for the previous year.
