Pursuant to sections 13, 20, and 75 of the Fisheries Act 1996, the Minister of Fisheries gives the following notice after complying with sections 11, 12, 13, 21, and 75A of that Act.

1 Title

This notice is the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Amendment Notice (No 2) 2019.

2 Commencement

This notice comes into force on 30 September 2019.

3 Application

This notice applies on and from the first day of the fishing year starting on 1 October 2019.

4 Principal notice

This notice amends the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (the principal notice).

5 Schedule 1 amended

In Schedule 1, replace each item relating to a fishstock code specified in column 1 of Schedule 1 of this notice with the corresponding item in that schedule.

6 Schedule 2 amended

(1)

In Schedule 2, replace the item relating to BNS7 and BNS10 with the items set out in Schedule 2 of this notice.

(2)

In Schedule 2, after the item relating to JMA1, insert the item set out in Schedule 3 of this notice.

(3)

In Schedule 2, item relating to SWA1 and SWA4, delete “, SWA4”.

(4)

In Schedule 2, replace the item relating to SWA3 with the item set out in Schedule 4 of this notice.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice amends the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015. The amendments commence on 30 September 2019 but apply on and from the first day of the fishing year starting on 1 October 2019.

The amendments set or vary 1 or more of the following things for quota management stocks with certain fishstock codes:

the total allowable catch (TAC):
the total allowable commercial catch (TACC):
the interim deemed value rate (interim DVR):
the basic annual deemed value rate (basic annual DVR):
the different rates that apply to each level by which a commercial fisher’s reported catch exceeds the fisher’s annual catch entitlement (differential DVR).

The things set or varied by this notice are set out below. Anything not mentioned below is unchanged. Values specified in the principal notice may be overridden by various means. Where an original value is cited, that value is taken from the principal notice and ignores any change made without amendment to that notice.

Bluenose

for BNS7, interim DVR increases from $2.70/kg to $3.60/kg, basic annual DVR increases from $3.00/kg to $4.00/kg, and differential DVR changes to the special rates set out in Schedule 2 of this notice:

Cardinal fish

for CDL5, interim DVR increases from $0.26/kg to $0.27/kg and basic annual DVR reduces from $0.52/kg to $0.30/kg:

Elephant fish
