Building (Levy) Amendment Regulations 2024

These regulations are made under sections 53, 55, and 402 of the Building Act 2004—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Building and Construction made in accordance with section 402 of that Act.
Regulations
1 Title
These regulations are the Building (Levy) Amendment Regulations 2024.
2 Commencement
These regulations come into force on 1 July 2024.
3 Principal regulations
These regulations amend the Building (Levy) Regulations 2019.
4 Regulation 3 amended (Rate of building levy and minimum estimated value)
In regulation 3, table, after the last item (relating to building consents granted on or after 1 July 2020), insert:

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 1 July 2024, amend the Building (Levy) Regulations 2019 (the principal regulations).
Section 53 of the Building Act 2004 (the Act) imposes a levy on a person to whom a building consent is granted. However, under section 55 of the Act, the levy is not payable if the estimated value of the building work is less than the minimum estimated value stated in the principal regulations.
The principal regulations set the current levy rate and minimum estimated value.
For building consents granted on or after 1 July 2024, these regulations increase the threshold at which the levy becomes payable from $20,444 (inclusive of GST) to $65,000 (inclusive of GST).

These regulations are administered by the Ministry of Business, Innovation, and Employment.
