Order

1 Title

This order is the Diplomatic Privileges (Nauru Intergenerational Trust Fund) Order 2021.

2 Commencement

This order comes into force on the 28th day after the date of its notification in the Gazette.

3 Interpretation

In this order, Nauru Intergenerational Trust Fund means the Intergenerational Trust Fund for the People of the Republic of Nauru, established by the Government of the Republic of Nauru on or about 6 November 2015.

4 Declaration as to Nauru Intergenerational Trust Fund

The Nauru Intergenerational Trust Fund is an organisation of which the Governments of 2 or more States are members.

5 Body corporate

The Nauru Intergenerational Trust Fund has the legal capacities of a body corporate.

6 Exemption from income tax

The Nauru Intergenerational Trust Fund is exempt from income tax.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the 28th day after the date of its notification in the Gazette, gives effect to New Zealand’s obligations under the Memorandum of Arrangement between the Government of the Republic of Nauru and the Government of New Zealand Regarding an Intergenerational Trust Fund for the People of Nauru. The order provides that the Nauru Intergenerational Trust Fund has the legal capacities of a body corporate and is exempt from paying income tax.
