Cadastral Survey Amendment Rules 2023
These rules are made by the Surveyor-General under section 49 of the Cadastral Survey Act 2002 after complying with section 49(2) and (3) of that Act.
Rules
1 Title
These rules are the Cadastral Survey Amendment Rules 2023.
2 Commencement
These rules come into force on 1 July 2024.
3 Principal rules
These rules amend the Cadastral Survey Rules 2021.
4 Rule 25 replaced (Use of class D)
Replace rule 25 with:
25 Use of class D
Class D must be used for a boundary and its associated boundary points that have been accepted under rule 15, except for—
(a)
a water boundary:
(b)
a water centre-line boundary:
(c)
an irregular boundary.
5 Schedule 5 replaced
Replace Schedule 5 with the Schedule 5 set out in the Schedule of these rules.

Schedule 5 Official vertical datum

The official vertical datum is New Zealand Vertical Datum 2016 (NZVD2016).
NZVD2016 is defined in LINZS25009: Standard for New Zealand Vertical Datum 2016.

Explanatory note
This note is not part of the rules, but is intended to indicate their general effect.
These rules, which come into force on 1 July 2024, amend the Cadastral Survey Rules 2021 (the principal rules).
Rule 4 replaces rule 25 of the principal rules to resolve a conflict with rule 29(1) of the principal rules. Rule 25 currently applies if an existing boundary accuracy is unknown or unable to be determined and it is appropriate to permit that inaccuracy to remain. Rule 25 currently mandates the use of class D for a boundary and its associated boundary points that have been accepted under rule 15 of the principal rules. Rule 15 of the principal rules covers various kinds of boundaries, including existing water boundaries, water centre-line boundaries, and irregular boundaries. However, rule 29(1) of the principal rules provides that accuracy classes do not apply to water boundaries, water centre-line boundaries, or irregular boundaries. New rule 25 resolves that conflict by excluding those boundaries from the scope of the rule, but otherwise has the same effect as the rule it replaces.
Rule 5 replaces Schedule 5 of the principal rules, which lists the official vertical datums that may be used in cadastral surveys. Currently, NZVD2016 or one of 13 historical local vertical datums (LVDs) may be used. New Schedule 5 mandates the use of NZVD2016, the recently developed vertical datum that covers the whole country and is compatible with satellite positioning systems. Until the close of 30 June 2024, NZVD2016 or any of the existing LVDs may be used.
