These regulations are made under section 402(1) of the Building Act 2004—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Building and Construction.
Regulations
1 Title
These regulations are the Building (Dam Safety) Amendment Regulations 2024.
2 Commencement
These regulations come into force immediately after the commencement of the Building (Dam Safety) Regulations 2022 on 13 May 2024.
3 Principal regulations
These regulations amend the Building (Dam Safety) Regulations 2022.
4 Regulation 5 amended (Meaning of classifiable dam)
Replace regulation 5(1) with:

For the purposes of the Act, classifiable dam means a dam that has a height of 4 or more metres and stores 20,000 or more cubic metres volume of water or other fluid.

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations amend the Building (Dam Safety) Regulations 2022 (the principal regulations) and come into force on 13 May 2024, immediately after the commencement of the principal regulations.
These regulations amend the definition of classifiable dam to exclude dams of lower height (1 or more metres but less than 4 metres storing 40,000 or more cubic metres volume of water or other fluid) from the dam classification requirements in subpart 7 of Part 2 of the Building Act 2004.
Under the amended principal regulations, a dam will only be a classifiable dam if it has a height of 4 metres or more and stores 20,000 or more cubic metres volume of water or other fluid.
