Local Government Members (2022/23) Amendment Determination 2023: revoked, on 1 July 2023, pursuant to clause 16 of the Local Government Members (2023/24) Determination 2023 (SL 2023/142).

This determination (to which is appended an explanatory memorandum) is made by the Remuneration Authority under the Remuneration Authority Act 1977 and clause 6 of Schedule 7 of the Local Government Act 2002, after having regard to the matters specified in clause 7 of that schedule.
Determination
1 Title
This determination is the Local Government Members (2022/23) Amendment Determination 2023.
2 Commencement
This determination is deemed to have come into force on 14 October 2022.

This determination amends the Local Government Members (2022/23) Determination 2022.

Explanatory memorandum
This memorandum is not part of the determination, but is intended to indicate its general effect.
This determination, which is deemed to have come into force on 14 October 2022, amends the Local Government Members (2022/23) Determination 2022 (the principal determination).
After the 2022 local elections, each council was required to provide the Remuneration Authority (the Authority) with a proposal on how its governance remuneration pool, which must be fully allocated, should be distributed among its councillors (excluding the mayor or regional council chairperson). The proposal includes the council’s recommended remuneration rates for their councillors who hold positions with additional responsibility (such as deputy mayor, committee chairperson, portfolio leader, etc) and for their councillors with no additional responsibilities.
The Authority considered the proposal received from each council before determining the remuneration payable to their individual councillors.
The Authority’s decisions are backdated as follows:
the remuneration for councillors with no additional responsibilities takes effect on and from the day after the date on which the official result of the 2022 election of members for the council was declared; and
the remuneration for positions with additional responsibilities takes effect on and from the day after the date on which the council made its formal decision on its proposed remuneration allocation.
Therefore, the councillors will move to their new remuneration in the following sequence. All councillors will receive backdated remuneration at the rate determined for councillors with no additional responsibilities on and from the day after the date on which the official local election results for the council were declared. Then those councillors with additional responsibilities will receive their new remuneration backdated to the day after the date on which the council made its formal decision on the proposed remuneration allocation for submission to the Authority. Those effective dates are set out in the third column of Schedule 2 of the principal determination.
This determination implements the Authority’s decisions for those councils that were unable to submit their proposals to the Authority in time to be considered for and included in the Local Government Members (2022/23) Amendment Determination (No 3) 2022, which was made on 20 December 2022.

1 General
This is a consolidation of the Local Government Members (2022/23) Amendment Determination 2023 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
Section 78 of the Legislation Act 2019 provides that this consolidation, published as an electronic version, is an official version. A printed version of legislation that is produced directly from this official electronic version is also an official version.
