These regulations are made under sections 167 and 168 of the Climate Change Response Act 2002 on the advice and with the consent of the Executive Council.
Regulations
1 Title
These regulations are the Climate Change (Forestry) Amendment Regulations 2022.
2 Commencement
These regulations come into force on 12 January 2023.
3 Principal regulations
These regulations amend the Climate Change (Forestry) Regulations 2022.
4 Regulation 15 amended (Fees and charges)
In regulation 15(3)(a), after “application”
, insert “or request”
.
5 Regulation 68 amended (FMA participant requests participant-specific tables)
After regulation 68(2)(b), insert:

be accompanied by the prescribed fee (if any).
6 Schedule 6 amended
In Schedule 6, replace the table with:

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 12 January 2023, amend the Climate Change (Forestry) Regulations 2022 to change some of the fees and charges payable for matters relating to post-1989 forest land. Broadly, the changes are as follows:
for an application to register as a participant for the activity of standard forestry, the fee plus hourly charge is changed to a flat fee (with the applicable fee depending on the area of the relevant post-1989 forest land):
for the submission of various emissions returns, the fee plus hourly charge is changed to a flat fee:
for travel for the purposes of checking that land is post-1989 forest land, the fee is increased:
for an application to add 1 or more carbon accounting areas to post-1989 forest land for the activity of standard forestry, the fee plus hourly charge is changed to a flat fee (with the applicable fee depending on the area of the relevant post-1989 forest land):
for a notice of transmission of interest, the fee plus hourly charge is changed to a flat fee:
fees are introduced for—
an application or a notice that relates to ceasing participation in the activity of standard forestry for the whole or a part of 1 or more carbon accounting areas:
a request for participant-specific tables of carbon stock:
the fee and hourly charge for an application to reconfigure carbon accounting areas is removed.
