These regulations are made under section 98 of the Screen Industry Workers Act 2022 on the advice and with the consent of the Executive Council.

Regulations
1 Title
These regulations are the Screen Industry Workers (Registrar Functions and Other Prescribed Matters) Regulations 2022.
2 Commencement
These regulations come into force on 30 December 2022.
3 Interpretation
(1)
In these regulations, unless the context otherwise requires,—
Act means the Screen Industry Workers Act 2022
Registrar of Screen Industry Organisations means the Registrar of Screen Industry Organisations appointed under section 94 of the Act.
(2)
Any term or expression that is defined in the Act and used, but not defined, in these regulations has the same meaning as in the Act.
4 Transitional, savings, and related provisions
The transitional, savings, and related provisions (if any) set out in Schedule 1 have effect according to their terms.
5 Application to register as engager organisation or worker organisation
(1)
An application by an incorporated society for registration as an engager organisation or a worker organisation must be—
(a)
made on the application form provided for the purpose on the Companies Office’s Internet site; and
(b)
signed by an officer of the society.
(2)
The information that must be provided is the following:
(a)
the name of the society:
(b)
the date of the application:
(c)
the name, email address, and postal address of the person who signs the application:
(d)
the office held by the person who signs the application.
(3)
The application must be delivered to the Registrar of Screen Industry Organisations by—
(a)
posting it to the postal address specified by the department; or
(b)
emailing it to the email address specified by the department.
6 Certificate of registration as engager organisation or worker organisation
(1)
The Registrar of Screen Industry Organisations must sign each certificate of registration as an engager organisation or a worker organisation.
(2)
The Registrar must ensure that each certificate of registration includes the following information:
(a)
a registration number:
(b)
the name of the incorporated society:
(c)
confirmation that the incorporated society is registered under the Screen Industry Workers Act 2022 as—
(i)
an engager organisation; or
(ii)
a worker organisation:
(d)
the date from which the registration is effective:
(e)
the name of the Registrar:
(f)
the date on which the certificate is signed by the Registrar.
7 Annual return of members of organisations
(1)
An officer of an engager organisation or a worker organisation must sign the annual return of members of the organisation that is delivered to the Registrar of Screen Industry Workers under section 85 of the Act.
(2)
The annual return must include the following information:
(a)
the name of the organisation:
(b)
its registration number:
(c)
the date of the annual return:
(d)
the name, email address, postal address, and contact number of the person who signs the return:
(e)
the office held by the person who signs the return:
(f)
the occupational contracts that apply to the members of the organisation as at the date of the annual return:
(g)
if the organisation is an engager organisation, the estimated number of members of the organisation that hire workers in each occupational group specified in Schedule 2 of the Act:
(h)
if the organisation is a worker organisation, the estimated number of members of the organisation in each occupational group specified in Schedule 2 of the Act:
(i)
the occupational contracts to which the organisation is a signatory party.
(3)
The return must be delivered to the Registrar by—
(a)
posting it to the postal address specified by the department; or
(b)
emailing it to the email address specified by the department.

There are no transitional, savings, or related provisions in these regulations as made.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 30 December 2022, prescribe details as to—
how an incorporated society may apply to the Registrar of Screen Industry Organisations to be registered as an engager organisation or a worker organisation for the purposes of the Screen Industry Workers Act 2022 (regulation 5):
the form of a certificate of registration as an engager organisation or a worker organisation (regulation 6):
the information to be included in the annual return of members of an engager organisation and a worker organisation (regulation 7).
