This order is made under section 4A of the Misuse of Drugs Act 1975 on the advice and with the consent of the Executive Council.

1 Title
This order is the Misuse of Drugs (Classification and Presumption of Supply) Commencement Order 2022.
2 Commencement of Misuse of Drugs (Classification and Presumption of Supply) Order 2022
(1)
The Misuse of Drugs (Classification and Presumption of Supply) Order 2022 (the principal order) comes into force on 15 December 2022, except as provided in subclauses (2) and (3).
(2)
Clause 5(1) (to the extent that it relates to fentanyl only) and (3) and clause 6(3) of the principal order come into force on 1 July 2023.
(3)
Clause 6(2) of the principal order comes into force on 1 October 2023.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order brings certain provisions of the Misuse of Drugs (Classification and Presumption of Supply) Order 2022 (the principal order) into force on different dates. Most of the amendments contained in the principal order come into force on 15 December 2022.
The principal order—
amends Schedules 1 to 3 of the Misuse of Drugs Act 1975 to include certain drugs in the lists of controlled drugs in Classes A, B, and C:
amends Schedule 4 of that Act to include specified precursor substances of fentanyl and methamphetamine in the list of precursor substances:
amends Schedule 5 of that Act to specify the quantities of specified synthetic cannabinoids, specified fentanyl analogues, specified synthetic opioids, ethylone and N-ethyl pentylone, and para-methoxymethylamphetamine (PMMA) that are presumed to be for supply.
Under section 4A(2) of the Misuse of Drugs Act 1975, this commencement order may be made only after the principal order has been approved by resolution of the House of Representatives. The House of Representatives approved that order on 5 May 2022.
