These regulations are made under sections 9 and 32 of the Russia Sanctions Act 2022—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Foreign Affairs made in accordance with section 8 of that Act.

Regulations
1 Title
These regulations are the Russia Sanctions Amendment Regulations (No 6) 2023.
2 Commencement
These regulations come into force on 21 July 2023.
3 Principal regulations
These regulations amend the Russia Sanctions Regulations 2022.
4 Regulation 12 amended (Sanctions on assets and services do not apply in certain circumstances)
After regulation 12(7)(f), insert:
(g)
if the dealing is incidental to, and necessary for the purpose of giving effect to, a dealing for any purpose for which a New Zealand person may deal with a restricted asset or restricted service under this regulation.
5 Part 1 of table in Schedule 2 amended
In Schedule 2, table, Part 1, insert in their appropriate alphabetical order the items set out in Part 1 of the Schedule of these regulations.
6 Part 2 of table in Schedule 2 amended
In Schedule 2, table, Part 2, insert in their appropriate alphabetical order the items set out in Part 2 of the Schedule of these regulations.
Amendment to Russia Sanctions Act 2022
7 Principal Act
Regulation 8 amends the Russia Sanctions Act 2022.
8 Section 31 amended (Power to use and disclose information supplied or obtained under other enactments for purposes of this Act)
After section 31(3)(k), insert:

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 21 July 2023, amend the Russia Sanctions Regulations 2022 (the principal regulations).
All the amendments fulfil the purpose of the principal regulations, which is to give effect to the Russia Sanctions Act 2022 by imposing sanctions in response to Russia’s military actions in relation to Ukraine (and in response to any assistance given to Russia from any other country or person in connection with those actions).
Regulation 4 adds an exception with the effect that the sanctions do not apply to any dealing that is incidental to, and necessary for the purpose of giving effect to, a dealing that is the subject of another exception.
Regulations 5 and 6 add the names of entities and individuals so that the sanctions regime applies to them. Those entities and individuals are Russian or Belarusian military or economic actors of strategic importance.
Regulations 7 and 8 amend section 31(3) of the Russia Sanctions Act 2022 to add the Immigration Act 2009 to the list of enactments in that section. As a consequence, information supplied or obtained under the Immigration Act 2009 may be used and disclosed in accordance with section 31 of the Russia Sanctions Act 2022.
