Russia Sanctions Amendment Regulations (No 4) 2024

These regulations are made under sections 9 and 32 of the Russia Sanctions Act 2022—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Foreign Affairs made in accordance with section 8 of that Act.
Regulations
1 Title
These regulations are the Russia Sanctions Amendment Regulations (No 4) 2024.
2 Commencement
(1)
Regulation 4 comes into force on 17 October 2024.
(2)
Regulations 5 and 6 come into force on 20 September 2024.
3 Principal regulations
These regulations amend the Russia Sanctions Regulations 2022.
Amendment coming into force on 17 October 2024
4 New regulations 20 and 21 inserted
After regulation 19, insert:
20 Information required in formal warnings
A formal warning issued to a person under section 20(2)(a) of the Act must include the following information:
(a)
a statement that the Attorney-General considers either or both of the following:
(i)
that the person, without lawful justification or reasonable excuse, has breached a sanction:
(ii)
that the person is likely to breach a sanction:
(b)
the sanction alleged to have been breached or likely to be breached (as the case may be):
(c)
details of the events or actions that led to the Attorney-General’s view:
(d)
the penalties available under the Act for breaching sanctions:
(e)
the civil enforcement mechanisms available under the Act in relation to sanctions:
(f)
where to find further information about the sanctions regime:
(g)
an address for correspondence in relation to the warning.
21 Manner of issuing formal warnings
A formal warning issued under section 20(2)(a) of the Act may be issued by—
(a)
personal delivery to—
(i)
the person being warned; or
(ii)
if the person being warned is a company, a director of the company; or
(iii)
if the person being warned is a trust, a trustee of the trust; or
(b)
posting it to the last known place of residence or business or work of the person being warned; or
(c)
sending it to the electronic address of the person being warned.

5 Part 1 of table in Schedule 2 amended
In Schedule 2, table, Part 1, insert in their appropriate alphabetical order the items set out in Part 1 of the Schedule of these regulations.
6 Part 2 of table in Schedule 2 amended
(1)
In Schedule 2, table, Part 2, insert in their appropriate alphabetical order the items set out in Part 2 of the Schedule of these regulations.
(2)
In Schedule 2, table, Part 2, revoke the item relating to Eshan Imaninejad.

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations amend the Russia Sanctions Regulations 2022 (the principal regulations).
All the amendments fulfil the purpose of the principal regulations, which is to give effect to the Russia Sanctions Act 2022 (the Act) by imposing sanctions in response to Russia’s military actions in relation to Ukraine (and in response to any assistance given to Russia from any other country or person in connection with those actions).
Regulation 4, which comes into force on 17 October 2024, prescribes—
the information that must be contained in formal warnings under section 20(2)(a) of the Act; and
the manner of issuing those warnings.
Regulations 5 and 6, which come into force on 20 September 2024, add the names of entities and individuals so that the sanctions regime applies to them. These entities and individuals are Belarusian defence entities, key political or military personnel, Russian actors operating the Zaporizhzhya Nuclear Power Plant in occupied Ukraine, Russian military research entities involved in the development of nuclear weapons, or Iranian actors providing material or strategic support to Russia.
