These regulations are administered by the Ministry of Transport.
Pursuant to section 88 of the Road User Charges Act 2012, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Road User Charges (Administration Fees) Regulations 2014.
2 Commencement
These regulations come into force on 1 November 2014.
3 Interpretation
(1)
In these regulations, unless the context otherwise requires, Act means the Road User Charges Act 2012.

Terms and expressions used and not defined in these regulations, but defined in the Act, have, in these regulations, the same meaning as in the Act.
4 Administration fees
The administration fees set out in the Schedule are payable for the matters to which they relate.
5 Waiver or refund of fee
The RUC collector may waive or refund the fee described in item 4 of Part 1 of the Schedule if the reason for the application to change the RUC vehicle type is that the incorrect RUC vehicle type was assigned to the vehicle by the New Zealand Transport Agency when the vehicle was registered to any previous owner.
6 Prescribed recipient
The administration fees payable under these regulations are payable to the New Zealand Transport Agency.
7 Fees exclusive of GST
The administration fees set out in the Schedule are exclusive of goods and services tax.
8 Revocation
The Road User Charges (Administration Fees) Regulations 2012 (SR 2012/138) are revoked.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 November 2014, replace the Road User Charges (Administration Fees) Regulations 2012 (the 2012 regulations).
Regulation 4 provides that the administration fees set out in the Schedule are payable. The 10 fees prescribed in Part 1 of the Schedule of the 2012 regulations are replaced by 8 new or amended fees. The fees for exemptions under section 40 of the Road User Charges Act 2012 are unchanged.
Regulation 5 is new and provides that the RUC collector may waive or refund the fee for an application by an owner or operator to change the RUC vehicle type assigned to a vehicle if the incorrect RUC vehicle type was assigned to the vehicle by the New Zealand Transport Agency in the first place.
Regulation 6 is new. It provides that the administration fees payable under the regulations are payable to the Agency.
Regulation 7 provides that the administration fees are exclusive of good and services tax.
Regulation 8 revokes the 2012 regulations.
Regulatory impact statement

Notes
1 General
This is a consolidation of the Road User Charges (Administration Fees) Regulations 2014 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
