This order is made under section 2 of the Grocery Industry Competition Act 2023 on the advice and with the consent of the Executive Council.

This order is the Grocery Industry Competition Act Commencement Order 2023.
2 Commencement of section 19 of Grocery Industry Competition Act 2023
Section 19 of the Grocery Industry Competition Act 2023 comes into force on 28 September 2023.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order brings section 19 of the Grocery Industry Competition Act 2023 into force on 28 September 2023.
Section 19 imposes a duty to comply with the grocery supply code, and provides that a person that contravenes the section is liable to a civil liability remedy (including an order to pay a pecuniary penalty or compensation).
This order is accompanied by companion regulations entitled the Grocery Industry Competition (Grocery Supply Code) Amendment Regulations 2023. Those regulations, which also come into force on 28 September 2023, set out the first grocery supply code for the purpose of Part 2 of the Grocery Industry Competition Act 2023.
