These regulations are made under section 29 of the Fair Trading Act 1986—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Commerce and Consumer Affairs made in accordance with section 29(3) of that Act.
Regulations
1 Title
These regulations are the Product Safety Standards (Multipurpose Ladders) Regulations 2023.
2 Commencement
These regulations come into force on 13 April 2023.
3 Interpretation
In these regulations, unless the context otherwise requires,—
articulation joint means a hinge that is capable of being locked in 1 or more positions
AS 1892.1:2018 means Australian Standard AS 1892.1:2018 Portable ladders, Part 1: Performance and geometric requirements
multipurpose ladder means a portable ladder that has 1 or more pairs of articulation joints that allow the ladder to be rearranged to function as all or any of the following:
(a)
a single ladder (with or without a stand-off):
(b)
a single-sided stepladder:
(c)
a double-sided stepladder:
(d)
a scaffold:
(e)
a work platform.
4 Product safety standard for multipurpose ladders
(1)
AS 1892.1:2018 (with the variation set out in subclauses (2) and (3)) is a safety standard for multipurpose ladders.
(2)
Replace clause 2.8.1(a) of AS 1892.1:2018 with:
(a)
The name of the New Zealand manufacturer or importer (whether the ladder has been made for sale or otherwise).
(3)
In clause 2.8.1(c) of AS 1892.1:2018, replace “AS/NZS 1892.1”
with “AS 1892.1:2018”
in each place.
5 Ladders to which these regulations do not apply
These regulations do not apply to second-hand ladders.
6 Transitional, savings, and related provisions
The transitional, savings, and related provisions set out in Schedule 1 have effect according to their terms.

1 Transitional provision until 1 September 2023
These regulations do not apply before 1 September 2023 to a ladder that complies with AS/NZS 1892.1:1996, Portable ladders, Part 1: Metal, as modified by Schedule 1 of the Unsafe Goods (Multipurpose Ladders) Notice 2021.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
The Fair Trading Act 1986 allows product safety standards to be prescribed in respect of classes of goods. When there is a product safety standard in respect of goods, a person must not supply, offer to supply, or advertise to supply the goods unless the standard is complied with.
These regulations, which come into force on 13 April 2023, adopt Australian Standard AS 1892.1:2018 Portable ladders, Part 1: Performance and geometric requirements as a product safety standard for multipurpose ladders. The regulations replace the Unsafe Goods (Multipurpose Ladders) Notice 2021, which expires on 5 April 2023.
