Rt Hon Dame Helen Winkelmann, Administrator of the Government
Order in Council
At Wellington this 21st day of October 2024
Present:
Her Excellency the Administrator of the Government in Council
These regulations are made under section 147(1)(c)(ii) of the Legislation Act 2019—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Attorney-General made in accordance with section 147(2) of that Act.
Regulations
1 Title
These regulations are the Legislation (Publication) (Rules Relating to Chartered Professional Engineers) Amendment Regulations 2024.
2 Commencement
These regulations come into force on 21 November 2024.
3 Principal regulations
These regulations amend the Legislation (Publication) Regulations 2021.
4 Schedule 2 amended
In Schedule 2, insert in its appropriate alphabetical order:
| Chartered Professional Engineers of New Zealand Act 2002 | s 40 |
Rachel Hayward,
Clerk of the Executive Council.
Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations amend the Legislation (Publication) Regulations 2021 (the principal regulations) and come into force on 21 November 2024.
These regulations amend Schedule 2 of the principal regulations by adding section 40 of the Chartered Professional Engineers of New Zealand Act 2002 (the CPENZA) to the list of empowering provisions to which section 74(1)(aa) of the Legislation Act 2019 (the Act) applies. Section 40 of the CPENZA is a provision that empowers the making of rules by the Institution of Professional Engineers of New Zealand Incorporated. Currently, the Parliamentary Counsel Office publishes the rules under transitional provisions in the Act. The application of section 74(1)(aa) of the Act will mean that the publication requirements that apply to the rules made under section 40 of the CPENZA are those set out in Part 1 of the principal regulations. This means that the rules must be published on the maker’s website and notified in the Gazette.
Issued under the authority of the Legislation Act 2019.
Date of notification in Gazette: 24 October 2024.
These regulations are administered by the Parliamentary Counsel Office.
